After Napsters demise last year it appears Audiogalaxy has gone down the same path in the last 24 hours........probably won't be long til Kazaa and Morpheus head down the same path.........

New York, NY, June 17, 2002 – The recording industry, music publishers and songwriters announced today that they have reached an out-of-court settlement with Audiogalaxy.com, the Napster-like clone, which requires Audiogalaxy to stop the infringement of copyrighted works on their peer-to-peer network.

The agreement follows a lawsuit filed in late May accusing Audiogalaxy of facilitating and encouraging widespread copyright infringement – a last resort step after repeated efforts to warn the firm of their liability were ignored or resulted in ineffective attempts to fix the problem. The suit was brought by the Recording Industry Association of America (RIAA), on behalf of its member labels, and the National Music Publishers’ Association (NMPA), on behalf of the music publisher principals of its licensing affiliate, The Harry Fox Agency, Inc.

The settlement reached would allow Audiogalaxy to operate a "filter-in" system, which requires that for any music available, the songwriter, music publisher, and/or recording company must first consent to the use and sharing of the work. The other key provision of the agreement is for Audiogalaxy to pay the music publishers and recording industry a substantial sum based on Audiogalaxy's assets and interest in resolving this case quickly.

"We are pleased to settle this case quickly. This is a victory for everyone who cares about protecting the value of music," said Hilary Rosen, Chairman and CEO of the RIAA. "This should serve as a wake-up call to the other networks that facilitate unauthorized copying. The responsibility for implementing systems that allow for the authorized use of copyrighted works rests squarely on the shoulders of the peer-to-peer network."

"The message is clear – there is no place on the Internet for services that exploit creators' work without fair compensation," added Edward P. Murphy, President and CEO, NMPA. "Such services hurt creators and hurt the legitimate Internet businesses that wish to comply with the law and compensate the creators. The swift resolution of this matter is thus a double victory that creators and legitimate Internet businesses should join in hailing." (more)

Audiogalaxy.com, based in Austin, Texas, was one of the more heavily trafficked file-sharing websites.

that sucks arse.

AG was by far the best one of the lot. Fastest servers, millions of songs. This programs do more good than harm anyway. How does the RIAA expect people to hear new music?? Most people wont go out and buy a cd without hearing some of the songs of it first, and Audiogalaaxy was the perfect place to check out one or two songs from bands you might be interested in. Now all the smaller bands lose a hell of a lot of exposure.

All because they are greedy pricks!!!!

it was the best by a long long way........the pricks in the corporate world win another battle but the war still has a long way to go.......

The RIAA and record companies will continue to lose millions and millions with their court actions whilst at the same time losing sales from people that were listening to new bands/music..........unfortunately the unsigned bands will suffer the most as the companies will continue to push their own crap on us.......

From reading the bulletin board at AG it seems a lot of people are going to either WinMX or Kazaa........hopefully in time they will build up to having the amount and wide variety of music that was available at AG........

So where will you be going now......???

same here.....as well as plenty of comedy from the likes of Derek & Clive, Monty Python & Robin Williams that were no longer available as well as plenty of other unknown artists........

I didnt have a problem with AG because you couldnt go there and download a top 40 song like you could on Napster. AG was awesome for rare songs, live songs, full live DJ sets at raves, b sides, unreleased songs, basically everything that a major fan of a band could want.

Now because the RIAA are a bunch of greedy tossbags, unsigned bands are left with nowhere to showcase their music, non commercial bands are left with nowhere to gain a new fan base.

I bought soooo many cds because of downloading one or two songs from bands on AG then going and getting their cd. There is no way im gonna go and buy a whole bunch of cds that ive heard no music from. The RIAA is biting its own foot of here. Id put money on that for every person that 'ripped' a band off, there was another new fan made that heard a song then went out and bought the cd.

I dunno where ill go now. For some reason, Kazaa just wont work on my computer, and i dunno why. I just downloaded Direct Connect so ill see what that is like.

I've been using iMesh since Morpheus tried it's "new direction", and have no complaints at all ... usually about 450,000 users online at a time ...

Thanks for the heads-up on XoloX though ...

I mourned the death of AG. I once really liked a song used on a Motorola ad - had no idea what it was called and found it there.

The best thing about it was being able to grab single songs by artists you normally wouldn't listen to. Eg: I like Pink's "Get This Party Started". I don't like anything else she has to offer, I don't buy CD singles and I'm sure as hell not going to buy 100% Hits Vol. 435 or So Lame or whatever compilation album it would appear on. Stuffed, I am.

Lucky I managed to grab a few rareties, acoustics, covers and songs with my name in them before the demise.

Thanx for the xoIox info Iceman......thankfully I've already downloaded my 300 songs from Audio galaxy. :)

Apparently the finger is being pointed at Metallica for getting this whole music download network going down. :( So, as EJ use to say, stick right up at you (metallica), you'll pay in the end.

(I'm glad i didn't cough up any of my hard earned on those ferals)

well, i used xolox and found it useless, now ive got Win MX and i must say, its much better

for anyone interested, it runs pretty much the same way napster did

wot the hell is up with this xolox i have downloaded one song and ever since the megabite usage has absolutely skyrocketed :mad: why does it open automatically when u click on the net too does anyone kno how to stop it doin that?

Because it is a 'Gnutella client' it isn't connected to a single server and bounces it's way around the net saying I'm available which chews up megabyte usage (upload only not download), way to limit this is

Tools -> Preferences -> Network -> and change the upload speed to 3 or less

and to stop it opening automatically is to take it out of your 'startup' folder

And yes, I've changed hosts heaps of times and it never connects.

(No silly questions about firewalls either. ;))

for once i agree with u M29

Anyone with a download limit who is using xolox i would advise you to check your usage meter right away because mine has been using up 500 a day since connecting to xolox when we only have 1000 for the whole month. Telstra tell me it's because of a file sharing program. 500 megabites a day when i have only downloaded 1 song from this heap of shyte program :confused:

I'm not worried about download limits, I have none :). My problem is the bastard never connects and when it does, it never downloads anything! Despite adding 30 hosts! :mad:
