So looks like charters and the other bloke won't be testifying now , so much for charter's BS quote he has information that could get the Drug cheats off, if this was the case then front up to the tribunal and tell everyone what the information is . I hope ASADA still have enough evidence to ban the cheats.
 
So they won't appear in court, but ASADA can still play the tapes, read the transcripts, present whatever other evidence they have related to the actions of Alavi/Charter, now the EFC/players now don't have an opportunity to ask "is that what you meant?" "care to offer an explanation/rebuttal" etc. The evidence will be presented and then both sides will argue the respective merits, without any input from the men themselves.

Given that Charter maintains he has info that could CLEAR the players I'm not entirely sure why some in the Essendon camp are hailing this as some kind of huge victory.

Starting to think Essendon are going to get off on this one. ASADA seemed pretty desperate to have Charter and Alavi there.

So could it be the case is that when ASADA go to use the recorded statements as evidence , the drug cheats lawyers can possible say it can't be used because they can't cross exam the witness etc .
 
Its time to put in our own sanctions as supporters, lets not turn up to the scums home games, lets not watch the scum on t.v. lets bleed them dry and deliver our own form of justice to the drug cheating scums that have made a mockery of us, lets deliver a sentance where no lawers can get in the way of real justice. If only I could make this happen somehow......... I hate Essendon and the Afl is a joke.

Nope, ASADA has said that they are already allowed to use the existing evidence they have from interviews and the ACC reports

They cannot use the acc info in the hearing

Acc info can only be used for investigative purpose, not for the actual prosecution

While both biochemist Charter and compound pharmacist Alavi had been relatively co-operative with ASADA until late November, both decided that they did not wish to attend the AFL anti-doping tribunal, in part due to the possibility of defamation. Neither were present in court on Friday.

David Grace QC, representing 32 of the 34 players indicated he was seeking costs, as did Tony Rodbard-Bean, acting on behalf of Alavi. Justice Croft decided to reserve judgment on the costs matter.

ASADA maintains that Charter sourced the raw materials for the banned substance, which were in turn compounded by Alavi, for Dank to provide to the players. Its chief executive Ben McDevitt told Fairfax Media last week that he still believed the anti-doping body could be successful in the hearings, even if Charter and Alavi did not appear.

"Despite media reports to the contrary, while it is my preference for potential witnesses to front the tribunal in person, I do not believe it is essential. It's now time to test this evidence in a tribunal and we are ready," he said.


The tribunal hearings will be held behind closed doors at the County Court, following the decision of its chairman David Jones QC, which was handed down earlier this week.
