It is well known in the prison system that Jason was not involved in the killings. He upheld his right to silence and was stitched up by association with Debs. The cops most likely stitched him up because he didn't co-operate with them. A soap opera gets spun to the jury against a man that remains silent and he is placed in a position of compromising his beliefs or going to prison for a long, long time. He chose to stand by his principals.
Jason is universally respected amongst the inmates and by many of the prison guards. He has no contact with Debs whatsoever. It takes a special man to exhibit this kind of strength..

"2 of them, one on foot".
There is no other suspects.

1) A dying man can say all sorts of things, dependent upon the stage of his cognitive decline.
2) "2 of them, one on foot" is not "2 of them, one of them was Jason Roberts"
3) "There is no other suspects" can be an incorrect summation if it is not based confessions.

Thousands of people per day make such comments when they have an abrasive interaction with the police. Bullshit also gets spun to juries and judges on a daily basis.
Interesting to note that you place faith in an ambiguous statement given to a jury:

over a clandestine tape recording of a conversation between Debs and Roberts:
..........a bugged conversation between Debs and Roberts allegedly captures Debs suggesting they had never been pulled over together.
Remember people, "beyond reasonable doubt"

There is enough to at least take a second look and review.
The government is being shockingly bloody minded on this. In order to appear tough on crime they risk breaking the system down all together. Talk about cutting your nose off to spite your face.
