Judging by this thread we can expect an announcement on the 2016 Grand Final, Cola, and Port Adelaide's most recent year's period.

On a serious note, do the AFL find themselves in legal peril here?

Does Clarkson stepping away (down?) because an investigation the AFL CEO is on record as saying would be done before Christmas 2022 is still dragging put them in a position where they are in breach of a duty of care to him?

It's such a giant mess.

Don't forget that Kennett is a very experienced political campaigner. This is all second nature to him.


He's destroying Clarko by a thousand cuts while trying to make the Hawks club look good.

He hates Clarko and when this opportunity fell in his lap he has used it for his own advantage to destroy an enemy.

There is a Machiavellian element in all this .
 
This could all have been avoided, Clarko.

In any case let’s hope the AFLCA isn’t working with or helping Clarkson in any way. We wouldn’t want to get half a suggestion that the AFLCA sympathised with Clarko or felt he’d been hardly done by.

Hawthorn have much to be accountable for.

Let's hope they are properly reprimanded, and bear the weight of their behaviour, governance failures, cultural problems, avoidance, and the destructive ripple effects it is having on the lives of all involved.
The AFL's investigation should centre on how much Hawthorn knew and when, and what oversight they had. And in hindsight, should have had. But the focus wouldn't be on the punitive side, it would be on what can be learnt and should be applied league-wide.

The big thing for me is the conflict of interest a coach has between player on-field performance and player welfare. Seems they'll defer to the club doctor on injuries, but maybe need to look at other areas of employment and how they are handled (i.e. relocations, support for people who have just moved). Don't forget, the way the draft works is that 18yo kids are sometimes forced to move across the country to pursue their career path which is difficult enough for most people, let alone those with large cultural differences.

I doubt many clubs had in place proper welfare procedures and normal employer-employee and managerial procedures in place.

The AFL have enough provisions in their contracts to be able to wiggle out of most issues as far as I know

The initial investigation (which appears to have been botched) was commissioned by Hawthorn IIRC, not the AFL
 
It was a huge gamble for North to allow Clarkson to coach while this issue was outstanding.

It’s not about Clarksons guilt or not , just the turmoil it was always going to bring To North melbourne.

When it first happened and Clarkson and Fagan were placed "on leave", there were a few people who suggested the best thing North could do is come to an agreement for Clarkson to resign and just move on. It had nothing to do with their club.

It still looks like that would have been the smarter choice. This is going to continue hang over them.

Their goal has to be success on the field. As soon as you start putting other things in front of that, such as defending poor Alistair's reputation and standing, it's not going to go well.

Essendon knows this the hard way.

Of a shit situation, at least he's been talked into stepping down. It gives North half a hope of some oxygen and getting on and playing footy.
 
What do we actually know?

Some allegations have been leaked to the press or provided directly?

Clarkson and Fagan have said they deny what was said in the media but haven't had any formal and exact allegations provided to them?

Fault on both sides here

Even if they did wrong they should get a right to respond?

Yeah, he's radioactive. Took them a while to arrive at the correct decision.

The best thing now is for the investigations to be completed so everyone can move on.

Hawthorn need to admit their many failures properly. The sort of thing Essendon have still failed to do re their scandal.

Hawthorn should also make reparations to individuals, groups, the AFL community as a whole for massive and lasting damage done in their name, for their benefit, at their hand, at the expense others, and to the detriment of the game.

Hawthorn have benefitted from their own bad behaviour - there should be recompense commensurate with those facts as well. There are consequences for such terrible failures.

The club should be heavily sanctioned.

Its a mediation process. When they ask him his version of events, what do you think he might say?

That’s a separate topic to “did you properly manage the actions of your employees”, which would also need to be dealt with.

Oh good, you understand the process.

So if Hawks feel the claims made may have valid grounds and there is exposure to them, why would they put a former employee in the firing line hmmm? Would that not be an issue for Hawks, Clarkson and Fagan to work out before Hawks address the claims?

I'm trying to imagine if my employer took that approach with people relocating for work, or just with their health and well-being in general.

HR just have a sign on their door: "If you don't like it, just leave".
 
Pretty long bow. Perhaps he feels aggrieved as he has been presumed guilty and still has not received appropriate details to sufficiently address things
Yeah Clarko don't come across as easily aggrieved, was on the front foot last week.

Again, it's speculation, but it's fair speculation.
