I was home that day watching it all unfold live on television. He clearly incited the mob by instructing them to march to the Capitol and “fight, fight, fight or you’re not going to have a country left!” And a lot more. Rudy’s speech mentioning trial by combat didn’t do much to de-escalate the situation either.

He knew full well what he was doing and what the mob was going to do. His attempt to hide his real message and intentions to the rioters was about as subtle as his birthday message to Epstein.

I dont think Donnie asked the supreme court about who he can pardon. Evidently, the "convention" is that it is done to people who have served a significant part of their sentence and are model prisoners....but we should remember it was convention that John Kerr should listen to Gough Whitlam's advice.
