    The Law Conscription/National Service

An article today on News.com.au suggested that in the event of an imminent war conscription may be utilised to bolster defence numbers. Without resorting to fearmongering, in what circumstances, if any, would you support or accept the reintroduction of conscription? Given the connected social...

You clearly didn't watch the video if that's what you think Fitzgerald's position is.

There's always fringes, but I think the disappointment more stems from Disney imitating Disney and this being a reflection of where entertainment is right now. I like Sean Fitzgerald's take on the re-make:

As with the Rittenhouse matter nobody seems prepared to properly engage with the purported judgement on its merits. Instead everyone is up in arms because this impacts something that is important to their ideology. Just because you don't like the implications of a court decision, or the...

Probably didn't help that a couple of posters mentioned MSNBC earlier in the thread. They have had a particular bent about this case, Rittenhouse and ideological implications from the start. It has blinded almost all of their perceptions about the actual evidence posited in the trial and the...

Sounds like a case of malicious prosecution. When does he think this is going to lead? If it ends up in the Supreme Court how does he think the conservative majority will deal with him? There's a fairly compelling argument that the DOJ do not have the authority to action anything in any event.

The typical expectation is that a witness is required to give their evidence orally in court and be cross-examined on that evidence. Anything less is ordinarily considered a breach of due process and should be excluded. In some civil situations (say an asbestos client with advanced mesothelioma...

He stopped because he was about to suggest Binger might have given the defence grounds for a mistrial with prejudice and thought better of directly pronouncing strategy to the defence. Also the witness I believe you are referring to is Maurice Freeland...

Binger and Kraus were completely out of line on several occasions and had the jury been hung I think there was every chance of a mistrial with prejudice. Prosecutor's should care more about the truth and due process than just winning their case. They should be held to a higher standard of care...

I don't claim to be a supporter of the NRA and I'm sure that they have just as many money-incentive reasons for that slogan as ideological reasons. My fascination in this case is purely professional. I think a carefully thought out rational response in a heated situation is a good policy that...

Yes, there is absolutely an element of reasonable belief if the question was that of self-defence: "A person is privileged to threaten or intentionally use force against another for the purpose of preventing or terminating what the person reasonably believes to be an unlawful interference with...

If you incorrectly perform/try to perform a citizen's arrest you are criminally responsible for your actions. As the jury cleared Rittehouse of any wrongdoing in the initial Rosembaum shooting Huber and Maurice Freeland (aka Jump Kick Man) assaulted the defendant and tried to apprehend him...

I'm not going to rehash my comment from earlier in the thread. The criminal code of Wisconsin states as follows: "939.48(2) (2) Provocation affects the privilege of self-defense as follows: 939.48(2)(a) (a) A person who engages in unlawful conduct of a type likely to provoke others to attack him...

Does Binger not realise that it is illegal to point a gun (albeit unloaded) at another person? That awkward moment when the prosecutor has committed more crimes than the defendant.

I don't claim to have a grasp on the exact processes of Wisconsin criminal trials but I think so. 805.09 of the legislation suggests 5/6ths of the jury are required one way or the other to avoid a hung jury but I think that's only for civil trials.

Today (9am Chicago time) will be jury instructions and final arguments (2.5 hours each party). Then deliberations. Could take less than a day and receive them Tuesday Chicago time. Likely later this week. May drag out if it is heading towards a hung jury.

As to your first point the political chasm that has been created in the United States makes it very difficult for these "news outlets" to properly report. It is typically Fox vs the Rest. In this case the right are painting Rittenhouse as a conservative martyr and the left are painting him as a...

Well it does for the prosecution. Suffice to say, it's a bit of a hail mary because there's no other corroborative evidence of this alleged action. But as the legal burden of proof is beyond a reasonable doubt it is hard to envisage that a sensible jury would be virtually certain (as they are...

There is some argument that both he and Huber were victims of circumstance (i.e. they would've had justification in trying to stop Rittenhouse had Rittenhouse not had a legal reason to perform the first act of shooting Rosenbaum).
