Judge Anthony Kelly reads out a minute agreed to by both the government and Djokovic, where he quashes the decision to cancel Novak Djokovic’s visa, orders government to pay costs, and for Djokovic to be released from detention in 30 minutes with his passport and personal effects released to him.

The minute notes Djokovic was allowed until 8.30am when he was originally detained to respond to the notification to cancel his visa, but the decision was made at 7.42am.

It found if he had had more time he could have consulted more widely and responded further than he was able to.

Not sure if you are following what i’ve said. The immigration minister now has the power to cancel his visa on character grounds. I’m predicting they might very well use these powers out of spite.

I'm aware of that.
My post was directed solely at the reasons for the decision, as agreed by the Judge and both parties' solicitors, and that the claim that he had a valid exemption was not decided, was not one of those reasons.
 
Kinda wonder if he was a given the extra time if he would have been as successful today - because there doesn't seem to be anything suggested that he has a valid exemption for entering the country, just that he wasn't given sufficient time to respond to matters when originally detained for questioning
The decision reads to me that the cancellation doesn't stand because he should have been given the extra 50 minutes, but, as the visa he has doesn't allow for the type of exemption he claims then he would be on an invalid visa currently.
 
To be fair that is for good reason. It's just unfortunate you need to be a rich as Novak to hire someone who knows them all
Yes, as I said in another thread, my guess is that the ABF blokes had forgotten the time limits, or didn't have them at the forefront of their minds, because in 99.9% of cases they say "You're out", and they go.

So used to just doing their own thing they forgot the rules.

In any case, the situation here reads to me that ABF can now just say "OK, you've got another 50 minutes now to prepare your documents and claims. Show me why your exemption is valid in 50 mins or you're out son"

If what he said was true then wouldn't he be about and about covid positive the day after confirmed positive? That's grounds for cancellation on character grounds as far as I'm concerned.

Yeah. I'd love it if this meant his bogus claims actually got put to the test in a public forum.

Either way, this whole saga has made australia look like a pack of morons. It’s an utter embarrassment. They had numerous chances to stop him before he even got here.

In the interview, he said that he had it twice, in 2020 and last year, and produced a Positive PCR Test as at December 16.

I'm 100% on board with the hysteria stopping but not until hospitalisations drop. That's probably 3 months away. Until then the hysteria needs to be cracked up not down. This is hospitalisations, and the black line is NSW:
