You might want to talk to an employment lawyer before making bold statements like that. A breach of duty of care by either party in an employment contract is grounds for teh other party to terminate. The clause was added by the AFL not because they wanted to but because they had to legally, fail to put it in andin the event a player challenge and won the whole AFL collective bargaining agreement would be deemed illegal, which means that everything the AFL does with players collapse and we have a free for all.
Peter Gordon said this morning it would be a difficult things to prove. Contribute things like the player continued to play etc, there are a lot of technical details that may make it difficult. Not impossible but not as simple as some are making out if it was challanged.

So I've had a busy week at work and basically copped a 'Ryder's GOOOOONNNNEE' text from a mate & just stumbled upon this news in the last day or so - I haven't read through the whole thread ins and outs but seriously, can someone here summarise where we are at so far with Ryder?! Dot points preferred :) Is he in fact out of here?!

I've been trying to keep up but didn't WADA state is was under S0 because of lack of approval.

and hasn't it now been approved in USA by a government health authority?
no it's still WADA banned, because approval hasn't been granted by governmental regulatory health authority for human therapeutic use., ie GRAS doesn't qualify.

Also, GRAS is a pretty base level safety status, and putting small amounts in food is different do injecting larger doses but we digress

- A rule change was implemented in June, but does not take effect until November, that allows a player to be considered a delisted free agent if he is able to prove his club breached his contract.
- Ryder is rumoured to want out of the club, preferably to Brisbane.
- Ryders manager, Paul Connors is apparently using this breach of contract threat to force the Bombers to release Ryder to Brisbane for an 'unders' trade.

That's it in a nutshell.

Personally, making the assumption that it IS Ryders intent to move on I think its a piss poor excuse to leverage more cash.

And proving breach of contract is no easy thing if Essendon is set on fighting it. Ultimately, if the parties can not agree that a breach occurred (and one or both parties insist on continuing up the hierarchy of jurisdiction), only a court can determine a breach occurred. NOT the AFL.

Don't underestimate Connors' part in this (I think this is more driven by him than Paddy's missus if I'm to be perfectly frank). This is a man who essentially went to the media with 'Dustin Martin has quit Richmond', when in-fact martin had done nothing of the sort and never really looked like he actually wanted to leave.

Not saying Paddy doesn't have concerns, but for all we know Ryder has given Connors a clip over the ear and is now seeking out a new manager.

I can't tell anyone what to do, but it'd be good to see people putting this stuff to the side until our finals campaign is over.

Heck, that could be tomorrow night; 24 hours (or a few weeks) isn't too long.

We've been waiting 3 years to play finals again.

We've been waiting 10 years to win a final again.

We've had 18 of the most agonising months an AFL supporter has had to endure, including having the finals taken away from us during our best season in recent memory.

Focus on that.

Worry about this other stuff later, when the actual footy's over.

I never said that it was a forgone conclusion that he could prove it and the fact they it has taken nearly 18 months for him to voice his concerns over long term health implications since the saga started tell me that it could be difficult for him.

But the legal problems for the AFL if someone did prove it would of been massive if they didn't give players a way to terminate contracts under such a set of cirucmstances.

Essendon's blame game over Paddy Ryder another sign of a club off the rails

Having wasted yet another golden opportunity to put up its hand and take responsibility for the nightmare it has inflicted upon its footballers, Essendon instead chose the predictable path on Thursday of playing the man.

The club had two choices after Fairfax Media revealed that Paddy Ryder could depart the club mid-contract and move to the Brisbane Lions as a delisted free agent. One was to wrap its arms publicly and privately around Ryder and his disenchanted fiancee Jessica McDonald. The other was to point the finger at his manager.

The Bombers reverted to type and chose the blame game. It was a crazy and misguided choice. Not only did Essendon play the man, it played the wrong man.

Paul Connors is one of the game's most influential player managers, who, incidentally, looks after the contracts of several Essendon footballers. He is also one of the individuals least likely to benefit from the revelation of Ryder's issues on the eve of an elimination final.
