Chris, I have been following this case closely and been in the law caper for a while.

Your summation was spot on. Well thought out, solid legal reasoning and well... literally the best thing I've read on the topic to date. By a considerable margin.

Nice to have a safe thread on here, where we all can rejoice in the capitulation of such a corrupt organisation. Fine should've been bigger but $200k is still a fair whack. Many more lawsuits to come hopefully.

I think they will appeal, not saying they will get permission to appeal or be successful but I think they want to fight the whole drug cheat charge.
There is an angle being tossed around that some (not all) would have a right to appeal because the facts of their case were different to the majority. In other words, the reasoning applied by CAS doesn't apply to the indivdual facts of each individual case. I won't be suprised if some appeal.

Unfortunately they all chose to stand together and be tried as 1 and therefore they all get the same penalty. Can't see it going anywhere as unfair as it might be.

I don't think there was anything unfair about the penalties to the players. All of them signed the consent/waivers. They were all willing participants. Some of them lied to ASADA.

The lack of penalties to the cheating Essendon* Football Club demonstrates how far removed the AFL is from the real world. I am still holding out some hope that the AFL is taking this stance until all player appeals are finalised and they finally do the right thing and ban the architects of this saga.

I think the dirty dozen sitting on the sidelines could learn a thing or two about dignity and remorse from their new team mate Ryan Crowley, who got busted for a relatively minor indiscretion.

I mentioned that the Dons had been hit with a $200k fine to a workmate who follows Port. His response was "Oh what a shame", but it was dripping with so much sarcasm it almost knocked me over. Still laughing.




I guess you had to be there...

Good point. I neglected this piece of the puzzle. Makes it really damning for the 34 drug cheats. I can see that they will win law suits against the cheating Essendon* Club because the last thing these cheats want is for it to all come out in open court. They are trying really hard to silence Hal Hunter (the only player thus far that I have any sympathy for) as is the AFL because we wouldn't want to find out what they knew.

Between December 2011 and February 2013 the Essendon Football Club conducted a supplements program that was not properly controlled. The risk of the program was that the Essendon players may have been given substances that could be harmful to their health or that the substances may have been given in a manner that was harmful to their health. It was reasonably practicable for the club to have provided a system of work that ensured an appropriate procedure was used in the administration of the supplements. Between 15 January 2012 and September 2012 the club did provide such a system however failed to maintain the use of the system. The risk therefore continued as described above. The club pleaded guilty to both charges and was convicted and fined $50 000 on the first and convicted and fined $150 000 on the second.

Convictions for body corporates can't be spent either (unlike for natural persons). The EFC will forever more be a criminal club.
