Bollocks. In a professional sense, if you leave your company to start up your own and sign exclusivity deals with the suppliers of your old company, and actively recruit and target employees of your old company that's dirty business tactics.

There's a difference between "hiring" workers and "stealing" workers. And if he used inside knowledge of tender amounts that he helped prepare while working for IJF in order to steal business, he should expect to have the book thrown at him.

Does anyone else notice the morsel of information that is missing from this statement?

Afaik, he's accused of doing the modern day equivalent - allegedly collating confidential information based upon buy/sell pricing, all of their operating costs, all of their supplier relationships and details (specifically, I believe, overseas ones which IJF set up) and possibly even actual tender submissions, and using that specific information to directly approach and undercut projects IJF were tendering; while he was employed there.

I believe police have raided/seized information (computers) relating to the above; and these things rarely get this far without specific and provable allegations.

I couldn't believe it took so long for this to hit the media, but then again, that prick McGuiness was protected heavily by the media (when they should've torn him apart), I guess they take care of their own - even if their own is a complete arseh*le.


Fairlane - if I was you guys, I'd be figuring out how you can have your entire board sacked; they're complicit in every poor decision which has led you to where you are; yet they seem to skate along without a care in the world.

there is trade secrets, propriety information, intellectual theft and etc

and no, we'll tell the next afl coach "dont bring the intellectual property you know with you, that belongs to your former employer"

even better, you'll send a letter to the club asking the board, saying "afaik he has access to their training methods, drills, patterns of play, strategies. i respectfully request you ask said coach not to coach this game." the modern day equivalent. no?

or do we not ever appoint a coach who has a contact with another club? after all, we must have spoken to them while they were employed there. thats poaching people

Comparing an AFL Club to a corporate entity isn't realistic or valid.

You posted that if he'd been accused of doing certain things, it would change your view on the situation; I tell you he's been accused of doing those things, then you shift the goalposts again.

Think what you want; in my opinion, you should be bloody thrilled this has come out - now if you can find some dirt on Rhode, you can have faith in your coaching selection panel.

No, he can't.

IJF don't do domestic work - they do multi million dollar projects; like the Fiona Stanley Hospital in Perth.

They aren't going through this because they lost a couple of $20,000 domestic renovations to Aber & Co.

That quote was the point when I decided they've moved beyond idiocy and bias and have graduated to actively taking the piss. If they were just being biased and didn't want to mention that he was a former Crow, they could've just said 'former AFL footballer' or something. By listing his other two clubs but omitting the Crows, they're actively taking the piss.

It is completely wrong to suggest, or even imply, that all of the board are complicit in bad decision making. Don't come on here and make grandiose statements that you have no facts to back up.

FYI, our board has changed significantly over the last 2-3 years.

From the board that reappointed Williams, John Hood, Jane Jeffreys, Darryl Wakelin, Anthony Toop are no longer there and our President has just announced he's standing down.

EDIT: also... three of our current board were appointed late last year.

Apology accepted - it is dangerous to apply mud to people that we do not know. It often happens with posters on our own board, so you are not alone.

In court documents, the commercial joinery business claims Mr Abernethy and another former employee, Mark Warton, used inside knowledge to create their own company, Direct Project Services - while still employed by IJF.

Very poor form from an ex AFC player ;)

This is the part I find surprising. The police rarely get involved in matters like this. They are usually dealt with by a civil search order (an Anton Pillar order for the legal geeks out there).

What is surprising in this part of the story for me is that it doesn't appear that IJF have sought an injunction against Direct Project Services from acting upon the confidential information allegedly taken (or if they have, they didn't get it). If that's the case (big 'if' as these reports don't necessarily cover everything), I find it hard to believe that there was enough evidence for police to become involved.

I'm not saying it is untrue. It just seems like a very strange way to go about it. An injunction would have addressed IJF's concerns much quicker.

As for IJF's emotions, that happens. Former employers are often extremely pissed off when their employees set up in competition. That's often because they are real competitors with an edge over absolute newbie entrants. That doesn't mean that they have a claim though.

I am also surprised by Port Adelaide's and Abernathy's reaction to this. It wouldn't be the first time a director of one entity had been sued because of his actions at another entity. They usually don't resign from the entity unrelated to the accusations. I guess Port has had so much bad publicity lately, it is limiting the possible damage from this piece. On the other hand, perhaps it does go further than the usual case and there is possible criminal sanction on the horizon.

All over, it is strange.
