If you shoot someone, you are charged with intentionally causing harm (or whatever, I'm not a lawyer). If they die, you are charged with murder. It is the same action (shooting someone), but the result is different I guess this is the MRP's stance as well. If you bump someone, or sling tackle them and they aren't injured, you get a lesser penalty than if they are injured.
