ASADA completes probe, now preparing briefs

As the great warrior poet Pauline Hanson once said "Please explain"

Let us return to the original quote from Baldur, a highly esteemed member of the HTB:

So where are the infraction notices? Sitting in front of an ex-federal court judge while he ensures nothing as been left out.

Now I can't be any clearer - it is an impossibility that there would be draft infraction notices sitting in front of the former judge for him to review - an impossibility.

We can all discuss at length what he might or might not be reviewing, and whose idea it was to engage him, and what his real purpose is, etc.

But there is one thing we can all be absolutely certain about - there are no draft infraction notices sitting anywhere with the names of Essendon players on them, least of all, in the offices of ASADA, and therefore, we can say with 100% certainty that the former judge is definitely NOT reviewing draft infraction notices.

I wouldn't waste your time debating the zealots in this forum who live in cloud cuckoo land. Because if we follow their argument to its logical conclusion, every time a player eats or drinks, they must check the labels on each bottle/jar and call ASADA for clarification. Give up eating in restaurants or drinking in bars or the like, purchase all your food stuffs and liquids and cook at home. And forget about visiting general practitioners, because according to the zealots they have NO IDEA.
Truth is every athlete does have to do precisely that. There was a case last year of an athlete who claimed he ingested prohibited substances in meat he ate in China. It wasn't allowed as a defence because he could not prove by a chain of documentation, etc., that the beef had been contaminated.

Enough with the cheap shots. Please.

We are absolutely fed up with posters labelling each other trolls, idiots, *******, foamers, and apparently every other epithet under the sun.

It is not Bay 13 here, so stop treating it as such. If you aren't going to bother attacking a poster's argument, and just go the ad hominem route and play the man (or woman), don't bother posting at all.

This is a final warning, to everyone.

Non WADA compliant (Athletes signed up to the WADA code) people are not part of ASADA's jurisdiction. That is a matter for others like the ACC; from all accounts Dank has already sung like a bird to them.

Non efc afl players also visited his clinics remember, how's that not relevant?

Agreed. Especially if he wants to rely on some of it for a defence later on.

You mean the stat dec he provided. He misread the label title, he thought they were referring to a stacked deck.

Especially when he "takes it to court". And won't be able to refer to his records, notes etc. he's boxed himself in.

How do we know that?

Early reports on cop surveillance of one of his clinics. Players unnamed and ongoing status in the game wasn't reported

To be fair they could have just been getting vitamins or the other benign "treatments" he provided.

We have seen in the nrl his client list went beyond the club he was at, I think it's naive to think the same wasn't happening here

He's playing the semantics game. Don't pay attention.

I'm genuinely surprised that you would hold that view.

There is a clearly defined process. It's unambiguous. The process involves clearly defined steps which must be followed in a strict order.

The issuing of infraction notices (for a non-presence violation), is way, way, way down the road in terms of where we are at this point in time.

Way down the road.

It's important that people understand we haven't even moved past first base.

People on the HTB are high-fiving each other, and the obvious question is: why?

What has changed with Andruska's evidence to the committee?

All she did was explain the process, and she confirmed that the investigation was over, but in the case of Essendon, that had been obvious for a very long time.

Why are people on the HTB high-fiving each other?

He is showing his fetish for the overtly literal over understanding meaning. The infraction notices themselves cannot be in front of the ex-judge at present, just the brief of evidance that may lead to an infraction notice in due course. Sigh, I guess if I posted "eyes wide shut", he would say that was impossable.

Best to ignore him, like I do.

Big Footy needs a 'vexatious litigant' award.

Interesting to note that notable vexatious litigants include (source Wikipedia)

The Church of Scientology and Julian Knight

The point is that infraction notices will not come from ASADA, so it's an impossibility that the former judge could be reviewing draft infraction notices.

That's why I said it's impossible that he would be doing that.

That is fine, why would a CEO bring an ex Judge in to review evidence unless they thought they were heading to court, so I would presume infractions must be coming

Fair point.

I guess all these comments from Andruska (given in a Senate hearing - the main function of which is a review body) clarify is that the whole investigation hasn't fallen into the abyss - it is in fact now in latter stages.

Hard to read much more than that into it. Everything is still possible.

Yes, I agree with that, with the one qualifier that we don't really know whether everything said applies equally to both clubs involved in the investigation.

Essendon still saying they have done nothing wrong and still can't find the paper work on what they injected their player's with. I hippie they very slammed very hard the player's as well, the player's must be complete idiot's to have let themselves get injected in off site clinic's and not even bother to ask questions or do a simple Internet search.

Firstly, it remains an open question as to who invited the former judge in, and/or on whose order.

Secondly, it remains an open question as to what the real purpose of his appointment is (whether he comes in as a truly independent expert, which is a rarity).

Thirdly, when the transcript is finally put up, you will be able to read with your own eyes that Andruska's evidence was all over the shop, and in some places, contradictory.

Now, let me say that that is not a slur on her - she was receiving questions from a senator who was unfamiliar with the subject matter, and she led him on a merry dance, and it was over and done with inside 8 minutes.

As a head of an agency under the public spotlight - you'd call that a success every day of the week.

You'd have to say, there was a touch of the me, me, me, me, me about it, but once again, all done and dusted inside 8 minutes, all good from her point of view.

Couldn't have said it better myself.
