Tell the court you were on your phone and did'nt notice the light change.

Not to mention you were under the influence of alcohol and drugs, which may have impaired your ability to notice.

In regards to the OP, like others have said, not really grounds to contest a ticket. Some states have ''official warnings'' for certain offences - you need to have good driving history and write in a letter of apology (admission). Might be worth checking to see if that applies.

well on this fine you couldn't pay at the post office is what's wrong with it.

only gave me three options.
1. Go to the city in person
2. Pay by credit card.
3. pay by money order and send details.

all of them are a lot of work just to pay a fine. I remember paying a speeding fine at the post office, nice and easy.

Did he look nigerian??
 
Okay I recently received a traffic infringement for running a red light.

This is what happened and what I would base the challenge on. It was in WA and caught by a set red light camera. I travel the route three times a week and know that the camera is there. I remember that the light was amber and me thinking I had enough time to go through, but the light turned red pretty much the exact time that I crossed the line. I was not speeding as the notice shows.

Has anyone challenged such an incident and what was the outcome?

Post the actual law that you are supposed to have broken.

When I went to court for a speeding fine when I was on my P's (I had to go to court because they ripped all my demerit points off me for the one speeding event.....I thought that was unfair, but never mind) one of the guys in front of me tried to explain why he was pinged doing a burnout with the excuse of "I didn't realise I was doing it."

Everyone started laughing, even the judge let out a smile before restoring order. Worst. Excuse. Ever.
 
What's the fine in WA for getting done by a red light camera? I live in a town with no red light cameras but moving to Perth next year and what to know what the consequences are before I go running red lights haha.
 
A few years ago I got pulled over for running a red. Got asked why, and just fully admitted it was my bad, I was trying to catch the lights before they changed.

Noticed the copper was sporting a bit of mo growth (it was in November) and I was doing the same, so I just made a light hearted commented, "Hey, you're doing Movember, too?"

He lets me off, saying that someone else ran it as well so it wouldn't be fair, but we both know we were mo bros. :thumbsu:
 
Forgetting the circumstances in this particular case (age etc), why is entrapment an excuse? I've seen it on (non-fiction) TV shows all the time as a legitimate method of catching wanted crooks.
 
Entrapment laws are mostly an American thing. Basically, they draw a line between a police officer facilitating a criminal act in order to gather evidence (legal sting operation) and a police officer inducing someone to commit a criminal act that they otherwise would not have (illegal entrapment).

There are not really any written entrapment laws in Australia. Most police forces have policies against certain types of entrapment behaviour, and there is case law that may exclude evidence if the police have committed especially egregious breaches of the law themselves during the sting operation.

But generally, in Australia, as long as you fulfil the elements of the crime (intent, action, etc.) I'm pretty sure it doesn't matter how much the police egged you on. A few years ago I was at the traffic lights and saw a Commodore with dark tinted windows and P-plates pull up beside a heavily modified Falcon. The Commodore revved the engine loudly, rolled forward and back, challenging the Falcon.

The Falcon screamed away when the signals changed, and the P-plater promptly whacked on police lights and pulled him over.

Pretty bad to admit but I did a shocker a while back, speeding a bunch above the limit and yeah had to go into the station to make a statement. Got told i'd have my license off for at least 1 year and i'd get a letter of summance to court in the mail. My mate did the same kind of thing but was drinking and not speeding and had about 6 in the car (we're both on our L's) and he never ended up getting anything for it, like they just didn't send him anything. And well it's been more than three months since I was told I'd get the letter.

Is this just really odd or am I a chance to not get suspended like my friend? Been worrying about it for ages, would rather it be confirmed not coming or just bloody come, year 12 exams soon.
