nerd.The way our adversarial justice system works is that the accused must be found guilty beyond reasonable doubt in a criminal case. The jury can think that the accused has committed the crime but cannot find him guilty unless they are sure. In addition to this the jury must come to a unanomous decision. So if one juror is not satisfied beyond reseasonable doubt then the accused cannot be found guilty.
If Domaszewicz were to be tried in a inquisitorial system or in a civil trial where there is a lesser standard of proof he may well lose.
