When a free-to-air broadcaster does not intend to show an event on the anti-siphoning list, the Minister is empowered to de-list the event so that it can be shown on pay TV. The current anti-siphoning list was introduced in 1994 for a ten-year period, and expires on 31 December 2004.

'The anti-siphoning regime has provided effective protection of the sporting events most popular with Australian audiences, however, the current list includes some events that free-to-air broadcasters have not televised for some years,' Senator Alston said. 'In these cases, it may be beneficial to remove these events from the anti-siphoning list to enable them to be made more easily available to interested pay TV subscribers.'

The Federal Government has stated it believes that the Australian public should continue to receive the same level of free-to-air television coverage (including live coverage) that they have come to expect in recent years. The Minister determines which events are listed.

Senator Alston has said he would have to be thoroughly convinced of the merits before making any changes to events on the pay TV anti-siphoning list.

The Minister has directed the ABA to report on the findings of its investigation by mid-2001. It is expected that the ABA will invite submissions from interested members of the public. However it should be noted that the fact an event is listed on the anti-siphoning list does not prevent pay-tv from showing a delayed telecast or showing it in opposition to free to air TV. It just states that the event cannot be only shown on pay per view.
