Business & Finance Dodgy workers comp claimants

Worked with a bloke a few years ago who hurt his shoulder lifting cement sheets.

18 months later...light duties, dozens of visits to physio etc...he gets paid out 60K. Insurance company dragged it out as long as they could but he went along with everything they threw at him.

He now lives with his mother on a pension and hasn't had a job since. The 60 grand lasted about 12 months. Most of it pissed up against a wall and smoked in bongs.

Had a guy working as a "casual" for us. He was always complaining about not being able to get full time work - anyway, He another guy and myself were moving a heavy table into an awkward position and he decides that he should try and lay on the floor and lift the table into position. Me and the other guy explain that it is a bad option as you may hurt yourself, he proceeds to continue anyway.

Nek minnut HR is calling me into their office asking about the situation, because the man is trying to claim workers comp. I don't think he got it in the end, but I just dont understand how people could do it if they aren't really injured

Worst thing I ever did was feel guilty about a claim.

Hurt at work in unusual circumstances, went to hospital, referred for daily physio. No Physio <3 hours drive, and couldn't drive on medication, so "forfeited claims" due to not following medical treatment plan. I could have gone home, with local medical professionals, but made a decision to try and get back to work asap, didn't follow the tabled medical treatment as I didn't want "3-6 months" off work, and returned to work within the week.

Now, 9 years later I still need regular physio every few weeks, and range from pain-free to incapacitated and unable to drive. According to my physio, if not for my insistence at returning to work all those years ago, I'd probably still be receiving free treatment, and compensation as well. Punished for my want to work.

I had a dodgy back for years due to work, every time it would flare up I'd go to the docs and they'd tell me it was just muscle spasms. They'd prescribe anti inflams, I'd have 4 days off work and be back on light duties for a week or so. I'd be back on full duties within 2 weeks. In those initial few days after the flare up, I wouldn't be able to dress myself, dry myself etc. If I sneezed it felt like my spine was going to explode out of my back.

It finally went on me good and proper one day while playing work sanctioned cricket and I was bowling. I told this particular doctor my history and she order CT and MRI scans for me straight away. My back was ****ed from L3/4 down to L5/S1. I was sent for surgical opinions and they all told me with up to 5 years of conservative management I would probably be ok again but would have to give up sport and modify most of what I did. I would have to give up my job which I loved. I told him to operate which he did. I had rehab for 3 months and then surgery. After the surgery I was back at work within a month, back on full duties within 6 weeks and playing non contact sports within 2 months. Six months after the surgery I was taking a squad of trainees for PE and right at the end of the session on a stinking hot day in Canberra we decided to finish of the day with a quick game of indoor soccer, the ball came to me and I kicked it on my left and knew straight away that I'd done it again.

A 2nd bout of surgery was ruled out owing to the 1 in 3 chance they'd put me in a wheelchair, fusion was also ruled out because they'd have to fuse too much and I wouldn't be able to bend properly. I had 16 months of rehab on full pay. I was sent to a pain and injury management clinic I had an epidural done, physio, hydro the works. I was finally medically discharge from my career, barely able to walk, it was another 3 or 4 years before I was close to fully mobile again, I still have residual discomfort and the rare bad day that I just work through.

After my discharge I was well and truly ****ed over, harrassed by DVA / Workcover. I was unemployable so what did I do? My wife and I bought a post office in a small country town with an attached house so that I would at least be able to do something when I was able. My reward from DVA / Workcover for forking out a lot of money to buy myself a job? Go even harder on me to try and cut my payments as much and as quickly as they could. That was after they'd ****ed my over with my lump sum.

So to the OP, yes, there are a lot of people that rort the system and they know how to do it, then there are the genuine ones like me who don't know the system and are embarrassed about having to use it. But thanks anyway to you and your kind for making my life stressful and miserable for 4 or so years.

Bunch of pricks. Remember, it's not your money, it 'aint coming out of your own pocket.

Places like Centrelink and Workcover I couldn't work for, my conscience wouldn't let me.

Stress Leave is the biggest joke. How employes can go get their doctors to say 'Unfit for Work due to Stress' is pathetic by both employee and the money grubbing doctors.

My take on this thread is that absolutely - workers comp can be abused - which is terrible on the employer and the fellow-workers who have to carry the can, but it would be a terrible world without it.

I am glad there is strict scrutiny and hope that cheaters are made to repay the system.

Agree with OP that the current state of workers comp and the numbers of people receiving disability pensions are a joke.

The sheer number of disability pension recipients is absolutely ridiculous.

How many disabled/injured people should a country of 22,000,000 have?

Obvious, though it isn't necessarily lying per se. You shop around until you get one that is willing to dance to your tune. Then when you need to get some leave or a certificate or whatever you going back to him and get what you need.

Doctors don't work for free, even if you aren't paying them they're still getting there's. The more 'clients' they have the more money they make.

Obviously these doctors are rare but I know of one practice near me that has a reputation for being very 'worker friendly' and is frequented (and recommended) by a couple of leeches my parents know.

You should definitely form a lynch mob.

All they have to do is sign a form and tell them to come back in two weeks to get another certificate. They get paid and don't have to confront the whining employee about their non-issue.
I don't think you understand A) The level of scrutiny doctors are under, B) how doctors get paid, and C) anything else about doctors.

And you're living in fairyland if you think there aren't doctors out there doing exactly what he described.
