Actually has happened multiple times in both those leagues. Just this year in the NBA, James Wiseman refused to work out for the Timberwolves (who held the number one pick) because he didn't want to be picked by them and get stuck behind their All-Star center in Karl-Anthony Towns.
In 2004, the San Diego Chargers in the NFL held pick 1 and Eli Manning, the top QB prospect at that time, flat out told the team he wouldn't play for them if they picked him. They ended up picking him anyway and he got traded 45 minutes later, never putting on a Chargers jersey. Neither player nor clubs were penalised in these scenarios.
Countless other draft prospects in the AFL over the years would have told interstate clubs they'd prefer to stay in their home state, as you've said. Steve Francis' agent called Vancouver and literally told them not to pick him and he would never play for them. They did anyway and he forced a trade to Houston before the season started.
