The courts would still look at it differently, judge will question her as to why she never phoned 000 at the time of the threat, and why she never at all reported it to the police, instead, she went to the media, before going down the appropriate channels for a matter such as this to be dealt with.

If you truly feared for your life, you would call the police immediately.
This approach stopped decades ago, primarily because women were treated so poorly for late reporting that the vast majority of domestic assaults and rapes went unreported

As we have seen with several recent cases, if a witness is credible the police are now willing to support a case even if the victim reports the assault years after the incident

If she genuinely feared for her safety, and this according to the age the afl/RFC were unresolved on, it should be reported to the cops

Ultimately it's her call, but if rfc believe that occurred I would hope they encourage her to speak to the cops and discuss relevant charges being laid.

Any half decent lawyer will argue that anybody fearful of there life never makes a complaint to the police, never immediately calls for the police for assistance, and 2 days later instead of still contacting the police she goes to the media.

At best she can apply for a restraining order.

I get all the hysteria around women's rights etc, etc but **** me . has everyone just forgot that a teenager not long ago was the sex doll of a whole footy side and a manager and only the manager wore any punishment . I guess you called say dalsanto was punished by the publicising of his little prick.
Make dustin waiter at the restaurant for 3 weeks and do pre season with someone with elite running capacity like bellis . Give the chic a membership a poster of Lids for her wall and cellis' number .
All parties have win .

You may want to look at some of the recent assault cases in the media, a lot were reported years after the initial incident and were successful

The issue is often there is no physical evidence, so it comes down to the strength of the defendants testimony

He is just a kid and made a mistake, if we treated every kid that made a mistake the way you are asking then we would miss out on a masive talent pool with in the AFL system.

It's not as though he hasn't been trying to do the right thing since he screwed up last time and we all know he has a streak of rebel in him, give the guy a break IMO.
Why should they be given an opportunity to play AFL if they are threatening to stab / beating women (or anyone)?
Dusty has had several breaks so far in his career, to the point where no one was really interested when he tried to shop himself around last year.

Probably. I guess it depends on the severity. Threatening to kill someone whilst pointing a gun at them would certainly attract a different punishment than threatening to break someone's arm.
Threats to seriously injure, or kill another person is considered as an assault, but the threat has to create a fear that it would be carried out. Threats that are unlikely or impossible would not normally be considered as an assault. Threatening to kill or injure someone is a crime that is not taken lightly by the states. In Victoria for example, threats to kill as spelled out in s 20 of the Crimes Act carries with it a maximum of 10 years imprisonment if it is real, rather than fanciful.
Agree so in this instance, going via the law method, this is low level offence( 1st offence, no real intent etc). With this in mind, going all out on him ie a 12 month ban seems very harsh to me.

Would love his talent, unfortunately it is packaged with these type of incidents, doesn't pass the dickhead test, so no.
My post was in response to Punt Rd end saying there would be a stampede of offers. Bennell has a checkered past and had precisely 1 club - Fremantle - make him an offer. Martin is building a similar history, and wasn't overwhelmed with offers a year ago when he tried to shop himelf around after Richmond's contract offer wasn't high enough for him.

I would love to know why the AFL are sticking their noses in, I don't recall them doing that when the Hawthorn boys were being investigated for sexual abuse, or the many other cases that are even more serious than this?

I assume at worst this would be verbal abuse as he only threatened to hurt her, pretty damn stupid of Dustin and a really bad look for the club and him but not enough for a years ban, IMO, maybe a month and a heavy fine plus throw in some work at a women's refuge, where he might learn that its pretty gutless to threaten a women and really violence against anyone is just not on.

This is Dusty's first assault offence. You don't think he deserves another chance? It happens in society eg good behaviour bond for first offence.
Should cop his whack but lets not get silly.

So all this talk about lengthy suspensions is this to punish dusty or send a message?

If it's the later then normal people aka the vast majority of the population know that kind of behaviour is not on and the rest do we really think the next meathead is going to raise his fist towards his wife/girlfriend/daughter/random in the street then stop and think that because dusty got a year off maybe I should reconsider my options here.

The punishment should be something that makes Dustin realise his mistakes and actually want to change if the club is of the opinion that missing games will achieve this then so be it but the courts should be sending messages that this type of behaviour is not on and the club should be encouraging a police investigation. If this was a random person committing the same act there is no afl club to ban them or fine them what message gets sent in that case?
I actually would prefer it was before the courts, than just via the AFL and the club.

I also think this just goes to highlight why not many people have the courage to stand up to rowdy and antisocial behaviour from people who are under the influence of a substance, be it alcohol or something else. It severely impairs judgement and moral fibre and you just never know how the person will react.
Yep and why some people dont understand that Dusty didn't have a rational reaction to the criticism by the girl. Simply put, there is a reason why over .05 is considered to be not in control.

Luke Hodge - captain of the club gets caught drink driving (no suspension, $450 fine)
Michael Hurley - gets extremely intoxicated, tries to evade cab fare, kicks the cab driver in the groin and punches him after being approached for not paying the fare (NAB challenge & 3 weeks, no fine)
Taylor Adams - pleads guilty to affray and recklessly causing injury where one man ends up with a broken jaw (1 week, $3,347 fine)
Liam Jurrah - charged with a machete attack causing serious head injuries to a man (no suspension or fine - Melbourne said they would "stand by Jurrah")
Alan Didak - has a car ride with an accused murderer who starts firing shots out of his window, continues to drink with bikies at a club house after in Campbellfield (no suspension or fine)
Nathan Bock - assaulted girlfriend in public and caused property damage (1 week, $5,000 fine)
Daniel Kerr - charged twice with assault in 2007 (no suspension or fine)
Steve Johnson - is caught speeding almost 80km over the speed limit (no suspension or fine - Geelong officials dismiss it as a "brain spasm")

Ben Cousins & Michael Gardner - questioned by police over telephone calls they allegedly received in Melbourne that were made following a brawl and shooting at a Perth nightclub. Police believed they had conversations with at least one of the two men charged with disposing of the gun after the brawl (no suspension or fine)
Collin Sylvia - allegedly assaulted his girlfriend and threatened to kill a passerby who intervened. It is believed he was intoxicated at the time (no suspension or fine - Melbourne say they're "disappointed Collin didn't advise us of the matter")
Simon Goodwin - assaulted a photographer before threatening to "f***ing kill" him after running amok at an Adelaide pub at 11am (no suspension or fine - Adelaide call it a "learning experience")
Brodie Holland - was charged with assaulting two women out the front of a Melbourne nightclub ($2,500 fine, no suspension - Collingwood "disappointed")

Dustin Martin - is extremely intoxicated, threatens to kill/stab a woman with chopsticks in a restaurant after being told to "settle down" (potential delisting or 12 month suspension and maximum fine)

Plenty of other clubs supporters that are shooting their mouths off need to remember the saying about glass houses, I'm also not happy that the AFL are looking at this when all the above they have ignored, where is the consistency?
