EUGENE McGee isn’t allowed to have lunch without being photographed and tagged by The Advertiser last Friday as “Hit-run lawyer toasts freedom” – though no such toast occurred.

McGee also won’t be allowed to emerge anywhere without being hounded by self-appointed moral guardian Senator Nick Xenophon.

Targeted by a Premier Mike Rann as political fodder in his battle against lawyers, Eugene McGee has my sympathy. It’s a big call, given I have never met the man.

All this case illustrates is that however big a grub McGee is, 'medical practitioners' responsible for expert evidence such as this are a complete wingnuts they are.

News flash, if you do anything remotely blameworthy, just cast about for whatever unfortunate experience you have ever had at any time previous in your life, and voila, PTSD and a ready explanation. No doubt somewhere out there there is some bloke who has lived an entirely trauma free life, all I can say it is sucks to be him.

Two other comments about this.

If you drive pissed, you are essentially taking a calculated risk. You are risking the safety of other people, and you are risking your future liberty. I would hate to see a friend in McGee's position, because there is naturally an element of there but for the grace of god for most people but I'd hate to see a friend in the cyclist's position more. Basically, if you risk it, you have to wear the consequences. There is simply no other way for a legal system to properly function.

To avoid a serious immediate jail term after making such a horrendously bad mistake, I think you should either have to provide immediate assistance, or at an absolute minimum, turn yourself in before police track you down themselves. Anything else, and I reckon immediate jail is simply a must.

Except we don't have any evidence that he was pissed (due to his actions after) or that the death was as a result of McGee's careless/poor driving (due to the road being in the middle of no where.

What we know and our common sense can tell us that the above two are almost certainly true, we just don't know it for sure.

Stopping to render assistance is an absolutely scummy thing to do (and of course the irony being if he stopped to render assistance his BAC would have been taken and voila the messy situation avoided, him behind bars).

What a piece of shit. I'm no fan of the Advertiser but he deserves whatever they throw at him and more.
 
Australian Story - Eugene McGee

I watched this tonight. It is the first part of a two-part story, but I looked up a bit of info on the net about it.

It looks like a pretty poor indictment on the police and the legal fraternity in SA. On top of being a tragedy and an injustice for the victim's family of course.

I was wondering if anyone here from SA could add their thoughts?

Sad day in South Australian history. I assume most people would like to see some sort of closure for Di and her daughters, but that looks unlikely. Absolute disgrace that someone of his standing would seek to remain unaccountable for his actions.

South Australians have even less regard for the police and legal professions after this sordid affair.

My sincere condolences to Di Gilchrist and the members of her family who were tragically touched by this disgraceful event.

Thanks to the ABC for breaking out the ratings period with a big bang. Expect this episode to feature highly in the Walkley awards later on this year.

Convicted pedophile and former chief magistrate Peter Liddy did just that to protect his estate from his victims who were seeking compensation for being interfeared with as children by Liddy.

This whole story is dirtier than a nappy that wasn't changed for a month..
 
Hitting the guy on the bike was an accident. Leaving the scene wasn't, it was cowardly, selfish, morally reprehensible behavior. The maneuvering, lying and manipulative behavior by this guy is sickening, I hope he enjoys living with himself..................the prick.
 
Evidently in motor vehicle accidents if the one who is deemed to be at fault by more than 50 % has more alchol in thier system than the law allows, it aint no accident.
People go to gaol for it...It's why leaving a scene of an accident normaly brings harsh penalties...thats of course your not part of South Australia's ruling elite.
 
I hope I run into the low life one day. The type of person I would love to express my point of view to.

Di Gilcrist and her family deserve justice. I hope she keeps at this bloke so he never forgets what he did and gets to relive it everyday of his life.

The preview of the next episode of Australian Story hints at a few talking heads saying there may be grounds for a mis-trial, I bloody well hope so.

Australian Story have quite a shameful pattern of advocacy, in issues of the court, where they get thoroughly ACurrentAffair and TODAYTonight equivalent for the ABCcrowd.

demagogy best left for MAtt White and Tracy.

He knew the law and he put it to his advantage, it doesn't make it right by a long way, but put yourself in his shoes, would do you do any different to what he did knowing that potentially you were facing a spell behind bars?

We somehow expect our legal system to perfect, it's not, its an evolving creature. McGhee, found a way to exploit part of it and was very successful in doing so. That loophole has closed now. A perfect example of a fluid legal system.

I'm not defending the bloke, but let's not lot our moral outrage get the better of us. He'll also spend the rest of his life knowing that it was his fault someone died, and that can't rest easily with anyone.

No I wouldn't do what he did, the thought of a long spell behind bars for something like that terrifies me but I could not live with myself, the conscience, the guilt and knowing you killed someone and were too cowardly to admit guilt.
I would most likely kill myself, the guilt would get to me first, a long way before I thought selfishly of my fate behind bars.
What I fail to comprehend is how this human cancer can still practice law and defend the rights of others in a supposedly highly respected position.
I don't have any hate in me for many people but this person is one of them.
 
The biggest issue is the culture of looking after your mates, cause any person who has any idea about how things work would think in all probabilities that Mcgee was cut some slack by some people.....

To me they're as much to blame for the events after that 4wd run over Ian on a notorious stretch of road.
