I dont know im not a law fan.

But to publish a photo and a potentially career ending story about someone that MAY be true to a quarter of a million people should not be legal.


What kind of employer would sack somebody for having an affair though? They'd bring a huge lawsuit against themselves. Unless he's in the senate or something. Then he'd probably get paid off with benefits.
 
I didn't ask whether you'd deserve it, I asked whether you're ok with it happening to anyone and everyone.

I'm OK with it happening to anyone and everyone who is stupid enough to loudly brag in public about how dumb their wife is to not catch him cheating on her.

The only reason that you and I are talking about this right now is because hundreds of thousands of people have decided that he deserved it by sharing the picture. Like and share to bring him to justice!', then nobody would care, it wouldn't get shared and it would be a non-issue.

Agree, why should she bare sole responsibility for this getting out of hand? No way. These guys behaved ridiculously enough to get noticed and sound like thugs who deserve a bit of shit.
The woman has reacted in accordance with her outrage at the arrogance and arseholeness displayed by these thugs. But she's displayed a lack of foresight in how out of hands these things can get.
And then social media has reacted predictably.

If anything the woman and thugs should both learn a lesson from this.... but to say there should be prosecution etc - please, get a grip of yourself. :rolleyes:

I don't have Facebook but isn't that the whole point? People say what they think and gossip on friends, photos, celebrities, society etc.

So let me get this straight. You're happy for total randoms to eavesdrop on a conversation, knowing nothing about the participants or having any context whatsoever, to make an arbitrary judgement on whether somebody "deserves" public humiliation... and then for potentially millions of other people to completely trust this observation and contribute to this humiliation.

So how loudly are we allowed to speak? Do you spend much time on crowded trains? You can hear any conversation you want within a close radius. People don't need to be speaking loudly. Some people have a bit of a lack of self awareness too, so I guess they deserve it too. Should we just cover our mouths whenever in public and whisper to each other, careful not to alert the ubiquitous moral police?

And thanks for pointing out that jaywalking isn't on the same level as adultery when slandering somebody's reputation. Glad I had that explained to me.

That's the problem with these things. Hyperbole and exaggeration tend to get out of hand.
These guys sound like dicks but saying they are thugs is a bit of a stretch.
By the time the 300,000th share rolls around, they will stand accused of genocide.

Nobody knows, just like nobody has a clue about this guy or his life. Hence why it's completely unfair to plaster his photo around the world with some pretty vicious slander attached.

Somebody on the other side of the world saying "oh they look like dicks" or "they sound like thugs" isn't a fair assessment of somebody's character.

Too right, we don't really know at all. That's why I always err on the side of caution and ignore these things. I don't feel right labelling someone based on nothing more than a photo and a caption by a stranger when they haven't had a chance to defend themselves or tell their side of the story.

Same goes for all those videos that get posted on places like /r/JusticePorn that are labelled 'Bully gets what he deserves' and all you see is a guy getting beaten up and no evidence to suggest he was the aggressor. There are many examples of stuff like this.

According to the caption, the guy was talking loudly on a train for 2 hours about cheating on his wife. It'd be difficult to misconstrue that. I don't know why you're misrepresenting this as if it was some covert operation of a woman sneakily dropping in on their conversation, hearing one dodgy sounding sentence and then putting 2 and 2 together and getting 5.

To be clear, I'm only OK with this if what the women has said is an accurate description of what the guy was talking about. It's true that we don't know whether it is or not. But, IF it is, then good on her and **** that guy.

The guy was in a public place and he wasn't talking to her, he was in a conversation with somebody else. She was eavesdropping, maybe not purposefully initially, but FFS, she's hung around to two hours to listen to the lot. And the guy didn't know his photo was being taken, and didn't know it'd be broadcast around that world.

I'm not misrepresenting shit. That's completely covert and sneaky.

The problem is if you condone this is one case based on some uninformed, arbitrary moral judgement, you open the door for any random, moronic busybody to do the same based on their own uninformed, arbitrary moral judgement. That's a slippery slope to a shit of a world.

You can't just say its ok IF its true. That's the whole point, this woman (as much as she might think she does) doesn't have a clue if its true or not. Nor does anybody else.
 
I can't imagine that posts on Facebook can be considered slander at all. It's mostly used for people spouting their opinions from their soapbox. Zuckerberg would have been shut down long ago.

People have been sued for defamation for comments made on Facebook.

It's not about facebook themselves, it's the people who might say or do something defamatory whilst on Facebook.

It's actually just a website like any other, it doesn't exist in its own parallel universe.

I don't really care if it's true or not. Just interested in how the law applies online. If it's illegal then every photo without consent would have to be taken off social network sites.

I'm no lawyer but I beleive the laws of defamation don't just apply automatically and totally. If a person feels they've been defamed, it's up to them to bring an action. A judge then decides in a court. A judge isn't going to rule that somebody's been defamed if theres a photo of them and their girlfriend at a regular party or something.

Yeah, I guess that is true. What if you defame somebody from another country? Hard to get a hold of somebody across borders. It's interesting. I imagine online law will be a huge thing in the future.

Exactly. It's a legal and ethical shitstorm that we need to get our heads around, quickly. Technology has moved bloody quickly and unfortunately there's a downside to it.

I know one thing - if a News Ltd newspaper printed something like this by a journo who'd been sitting on a train, there's be an absolutely deafening amount of outrage. If its not cool for them to do it, it's not cool for just anybody to do it in a an age where one persons actions have such tremendous reach and power. There's a lot of scope for people to be hurt.
