Finally got paid , Thanks to RVic they where prompt and assessable through the whole process .

Meanwhile I'm at 8 weeks, 34 emails total, I've provided drivers licence and bank card, then got them certified, then bank statements & screenshots for 2 bank accounts over multiple months, and no progress.

RVic sporadically sends emails to me (longest was about 2 weeks with no contact).

This is what they do. If you win they will suspend your account. Then make you send a million documents over and over again and there will always be an excuse.

You need to contact somebody that overlooks these pricks.

if you threaten them with going to the OAIC for breaking privacy laws then they should give you your deposit back at the minimum, you can then try and get your winnings through other avenues.

There's no body that overlooks them. Racing Victoria is a power unto itself, and they can work at any pace they want and come up with any ruling they want.
In addition to Racing Victoria, I've submitted complaints to VGCCC, Victoria Bookmakers Association, the Minister for Racing (in Victoria), Victoria State Revenue Office (for the bookmaker attempting to evade Wagering taxes by threatening to void my bets), OAIC, ACCC, and AUSTRAC.

Despite bookmakers clearly breaching the Privacy Act and AML/CTF Rules, the general theme is apathy when it comes to bookmakers conducting themselves in this manner.

The only real options I see left are filing a police report and/or taking legal action.

I didn't even bother with threatening them, just straight up submitted a complaint with OAIC anyway even though I doubt it'll go anywhere.

The accused at Flemington on the 25/07/2023 did without lawful excuse withhold winnings belonging to sohohoho by recklessly engaging in a course of conduct which included requesting they jump through ten hoops, perform 15 star jumps and 25 burpees with the intention of causing physical or mental harm to the victim, including self-harm, or of arousing apprehension or fear in the victim believing they would not receive monies owed to them.


Apart from Intervention Orders (civil) being facilitated through Police applicants, Police only investigate criminal matters. This is purely civil.

4 emails in you should stop emailing them and just send emails elsewhere

Send a email to the Minister of Racing and Gaming etc in Victoria, as well and CC them in. That one seems to worry them the most

Fair enough, I wouldn't have gone to the police without getting advice from a lawyer anyway. I was just thought that breaches of legislation passed by parliament such as the AML/CTF ACT were criminal offenses when they have specified penalty units. e.g. obtaining identification under false presences is an offence.

I did send an email to Minister of Racing for Victoria a few weeks back, unfortunately didn't CC racing vic though, also lodged a complaint with OAIC. Nothing but crickets.. lol

RV's last email on Tuesday was "we are unable to assist you" after 8 weeks and the number of emails and all the documentation I provided.

Anyway, in the process of finding a suitable lawyer to handle this now.
 
If anyone is interested, I'm now at the point where I've proven the bookmaker is acting in bad faith.
Their investigation concluded that I was using a VPN and said they would void all my bets and return my deposit, which means that they didn't need all the certified documentation unless they were going fishing for something else to pick which they couldn't find. If they were smart enough and spent 5mins on google they'd realise I wasn't using a VPN.

In the interim, RV has been reviewing 1 email and 2 screenshots for 1.5 weeks now. The evidence is pretty clear cut 😂
Would be funny if RV said they can't resolve it after what I've given now.

pricks. they will look for anything. who cares if you are using a vpn. if you are losing they don't give a shit.

once u win... they will look for anything to not give you your money.

Im not talking about all books. Some are great. There is 1 or 2 who are complete thieves.

Can't say a bad word about Pointsbet or Tab. Helpful and polite and pay out.

I think the main point is when people sign up to a bookie they don't really sit there and read all the T&Cs. They expect if they don't do anything dodgy then they will get paid out on winnings. Using a VPN isn't dodgy but some bookmakers (if not all?) sneak it in as a clause.

Winnersbet is the problem for me. Bookmaker is Da He, he runs Winnersbet, Justbet, Puntnow, and Midasbet.

Wishbet is partnership run by John Stewart (218099) Walsh and Michael Joseph (219306) O'toole and Jonathan David (219192) Walsh and Peter William (219322) Jones. They don't seem to run anything else in Victoria.
If you raise the issue with Racing Victoria, they won't do anything (apart from waste your time) until you comply with the bookmakers requests as long as they are within the bounds of their terms & conditions. If you've complied and they've come back with an invalid conclusion, only then will RV step in.
There also seems to be no penalty or investigation into the bookmakers conduct afterwards. Basically RV doesnt care unless you have an airtight case against the bookmaker.

From the wishbet T&Cs:
6.11. Where we have any suspicion that you may have breached any of our terms and conditions, you agree to provide to us with a relevant statutory declaration or other information or documentation if requested by us to assist our investigation. You agree that if you do not provide the requested statutory declaration, information or documentation within 7 days after our request, that we will have reasonable grounds to suspect that you have breached our terms and conditions and can take action accordingly. You agree that this is a material condition of our terms and conditions.

Their suspicions will not be relayed to you for clarification meaning they can and will use this clause arbitrarily (more likely used when you have won money off them). "Other information or documentation" is very wide reaching as well.

Makes you hesitant to run any new accounts too far up before trying to withdrawal though.

Banning bonuses and inducements fixes a lot of this shit up
