This could be the new thing to get players big sentences for indiscretion, next Derby I would be telling the Eagles Players if I were coach to over exaggerate any and all contact and have Doctor Nick Riviera on standby to give the bad news that the player is close to death. Then play them the week after like nothing happened. I can see Nat Fyfe getting some 10-20 week sentences.

There is no way he should play again this year no matter what a court says.
Plus I'm sure the Eagles would not want that sort of distraction if and when they should make a prelim or a grand final.

Basis for this rumour may be another rumour that the Surgeon who operated on Brashaw's jaw may have stated that the damage done by Gaff was exaggerated by the Dockers medicos at the tribunal and in the press.
It may have been a hairline fracture, one dislodged tooth and three damaged teeth plus the obvious cuts and bleeding - not the damage that was stated in the press at the time.
Not that any damage is acceptable and Gaff still should have got his whack regardless.

Just repeating a rumour so don't shoot the messenger - but Brayshaw did seem to be talking a lot easier when interviewed shortly afterwards than one would expect from the damage apparently done according to the press at the time.

You know what the press is like - they're like vultures. Exaggeration - well I never.

Maybe restraint of trade - AFL prohibiting the player from fulfilling his contractual obligations to the club. I think the law in this area says that the restraint must be proportionate and reasonable if it is to be enforced. They would have to say that the whack given was completely disproportionate - this would probably only come up if they handed out a life ban or something. The 8 weeks or whatever seemed well reasoned and based on precedent, etc.

Weagles would have to bring the action, but I doubt they would dare, as win or lose they would be persona non grata with AFL forever. Perhaps they got legal advice on it which sparked the rumour.

Any appeal should have been lodged the day after the Tribunal decision.

Regardless of what was said in the media, the doctor gave pretty specific evidence at the start of the tribunal hearing about the nature of the fracture, the number of teeth displaced etc and the effect it would have on Brayshaw. And that's what the tribunal went on, not the media reports.
