Is Battered Spouse still a defence?The 51yo murder victim Michael Carroll had previously served at least two years and one month in jail after a 2014 assault in which he stomped on a man's head, bashed him with a baseball bat and used a pair of pliers on his fingers, toes and testicles.
Police were called to a home in Tenambit, in Maitland, around 7.20pm and discovered a man suffering two stab wounds to his upper torso.
Michael Carroll, 51, was treated unsuccessfully at the scene by police and paramedics.
His 23-year-old daughter, Maddison Hickson, was arrested at the scene and taken to Maitland Police station where she was later charged with murder.
Detective Inspector Urquhart said a number of other people were at the home at the time of the incident and had been assisting police.
He said police were treating the incident as "a domestic violence murder".
"At this stage, we don't know what has led to the incident and that is currently subject to ongoing investigation."
He said a weapon was yet to be found.
