Unsolved Hayley Dodd Murder & Trial Updates

According to news bulletin on Nine a few minutes ago an arrest warrant has been issued for someone to be charged with her abduction and murder.

No clues as to who, but the issue of a warrant means either (a) the person is not currently in Western Australia; or (b) the cops don't know where the person is.

Be interested to see if this turns out to be Ward involved in Govan case. Will we hear how and where he made his way to Queensland.

The evening of Thursday, October 7, was a night like any other — Ms Govan’s partner was working night shift and she decided to go out drinking with friends about 10.30pm.
She drank all night at a number of Kalgoorlie bars, winding up at the Safari nightclub on Hannan Street.
When the bar closed at 4.30am, however, she decided not to return home.
A security camera captured her climbing into a taxi about 4.45am with a bald-headed man.
It is believed she went to the clubhouse of bikie gang Club Deroes on Boulder Road, where she was talking to two men outside the building about 7.30am, October 8.

Ex-cop describes ‘red flags’ in Hayley Dodd case

The detective who headed the investigation of the disappearance of Hayley Dodd in 1999 testified that too few resources were devoted to the case — despite his early belief the teenager was “the subject of foul play”.
Testifying at the Supreme Court trial of the man accused of murdering the 17-year-old, former major crime detective Eddie Rowe also said Francis John Wark was a person of interest in the early stages of the probe.

The below link continuation someone else's conversation elsewhere..

So police have a hair, and an earring found in Warks house-mate's ute.

The indicator stick had been broken according to the owner, Warks house-mate that Wark 'borrowed' the ute off. Warks house-mate alleges the ute was parked in the shed which was out of character according his house-mate.

Wark had promptly sold his house to Kahu Smiler (Shearer) before Wark departed the state for Queensland.

Thanks for your thoughts Dan. I've just realised Alec is posting about the two woman on trial. Some of us you have to spell it out for.

I can move to the Wark thread which I've just found as well. Ute not parked in it's normal spot? What did the shopping tell them?

http://www.perthnow.com.au/news/wes...n/news-story/c4ed1262234353a27f102c7c095e2515

Imagine if they pulled his shopping list?

As usual we know so little. Fair enough, but if you were the investigative team, you would be checking the card transactions. In this day and age, the retailer could just about trace what was purchased in their database as they have flybuys database which amasses shopping models of particular shoppers habits.

While I'm going for, "he spent cash", there is other means depending on the store such as security vision etc.

Hair plus earing plus broken indicator stick, plus car parked where he has not parked it anywhere else.

Im presuming, and I may be wrong, the witness that described Hayleys passing with palms against window in a white Landcruiser match the Landcruiser description of the house-mate's ute?

I would like to know exactly what motorbike Wark owned? (Moto Guzzi)

While there is plenty of bald men in the world, will we see a third murder case of Lisa Govan as per pointed out by another member on the Internet?

Or based on principle of, where there is smoke, there is fire, someone else has been up to kalgoorlie.

While there are plenty of motorbike owners in the world, was motorbike WARK hangin out at the Kalgoorlie clubhouse of a particular bikie gang where a co owner has been charged for drug distribution?

I do believe motorbike Wark lived in Mosman park in his younger days T.B.C.

Hayley Dodd went missing July 29 1999, Lisa Govan went missing 8th October 1999.

No body, no parole in WA now. Throw away the key?

Francis John Wark sold the Wheatbelt property shortly after 17-year-old Hayley vanished in 1999. He later moved to a small town in far north Queensland. As police yesterday continued their search around the farmhouse, about 1km from where Hayley was last seen hitchhiking, it emerged that Wark had been jailed in 2007 after pleading guilty to attacking a 32-year-old woman and holding her captive at his Queensland property.

https://thewest.com.au/news/wa/former-land-owner-in-jail-for-rape-ng-ya-361923

During an appeal in 2008, where his jail term was cut from 13 years to 12, Justice Keiran Cullinane said Wark told the woman he was going to "keep her" and that as long as she did as he said, she would be fine.

The woman feared she would be killed and her ordeal ended only when she managed to get free of her rope binding and Wark went to another room. He chased her but she managed to reach a neighbouring house where the residents helped her and called police, the court was told.

Talk about a fire sale. 4 weeks? Speedy home sale and gone was Wark.

Kahu Smiler has been living in and out of his car for the past four months due to the state his Badgingarra property was left in after the search.

Mr Smiler’s finances have almost dried up and he can barely afford food, he told Nine News tonight.

“It makes me feel embarrassed to face people,” Mr Smiler said.

“It’s a disgrace that I’m living the way I’m living.”

Mr Smiler bought the house from convicted rapist Frank Wark just after Hayley Dodd went missing in 1999.

Darkan is obviously a pretty prominent shearing destination? Mr Smiler wears a 'Darkan' shirt which is wear Don Spiers (Sarah Spiers father) runs his shearing business and Don also owns property.

I presume Kahu knows Don Spiers and had dealings with Don in the past? Its a small arena in the shearing world. All these people know each other.

He had a shopping list for cops!

When Mr Wark was first interviewed in August 1999, he told police he visited the video shop before going to the post office, newsagency, bakery, supermarket and butcher where he bought a fortnight's worth of meat.

Guess the judge wanted to test if there was or wasn't enough time to get all the shopping?

In an event that was shrouded with secrecy, Francis John Wark was ushered through Moora's main streets surrounded by prison guards and police as Supreme Court Justice Lindy Jenkins, who is hearing his trial without a jury, viewed key landmarks in the case on Thursday.

Wearing a black suit and white shirt without a tie, Mr Wark walked slowly in the middle of the procession of prosecutors, defence counsel and security as he retraced the steps of the shopping trip which he says he was still in the middle of on July 29, 1999, when Hayley was allegedly killed.

Didn't realise that. Did Wark sell Kahu his house and motorbike?

Another girl went missing from Kalgoorlie a few months before (or after?) Hayley and she was last seen with a bald man getting into a taxi outside a bikie club?

Many coincidences perhaps. It's getting complicated.

One of the links you posted the cops were have a very close look with some finger pointing, under a slab on the property search. Did nothing come up?

So Wark sold his house to Kahu Smiler only 4 months after Hayley disappeared.

Did Kahu live there until police searched the property 12 months ago?

Kahu's a shearer and has a Darkan T shirt and may know Don Spiers. Is that correct?

Toyota Landcrusier not the same as a ute.

Bradley John Davies saw Hayley looking out the window at him in a white Toyota LandCruiser, when it passed his car as he was driving to Perth.

https://thewest.com.au/news/wa/hayley-dodd-looked-at-me-with-palms-up-to-the-window-ng-b88633414z

In a statement to police in 2010 and read to the court by prosecutor Brett Tooker yesterday, Bradley John Davies said he was driving to Perth when he saw a girl walking along the side of the road.

Mr Davies, who could not be found to give evidence in person, said he did not pick the girl up because he had already agreed to give a lift to a man whose Kombi had broken down in Newman.

He said that a short time later a car, which he described as a white Toyota LandCruiser, came “flying” up behind him.

He said as it passed, the girl he spotted earlier looked out the window at him with her palms up to the window. “I believe that girl to be Hayley Dodd,” he said.

White Toyota Landcruiser with girl witness believes to be Hayley in it. Sounds like it couldn't be Wark. However where was Bradley Davis at the trial? Does it mattter if he wasn't there?

Kahu was sold the house,. Not sure about motorbike.

It might have been a Toyota Landcruiser ute, but there appears no descriptive association in the media.

Its just hard to grasp that forensics miss this evidence first time round.

The earring was not found until 2013, during a review of police exhibits, in which the utility's bench seat cover was examined.

The court was shown a photograph of the bent earring — an Egyptian-style cross, or ankh — followed by a drawing by Ms Dodd's friend of a similar piece of jewellery she was believed to have been wearing on the day she disappeared.

If Kahu Smiler is a shearer, he has a Darkan beach party singlet on, Kahu more than likely may have worked for Don Spiers (Sarah Spiers father) at one stage.

Don Spiers has a shearing business that operates out of Darkan. Not sure how many shearing contract companies there is in WA?

Small world isnt it...

Driver claims he saw Hayley Dodd in phone box four days ‘after her murder’

https://thewest.com.au/news/wa/driv...-box-four-days-after-her-murder-ng-b88661751z

A tour bus driver said he saw Hayley Dodd using a phone box four days after prosecutors say she was abducted and murdered.

In a statement to police, Gingin man Sean Troy, who has since died, said he saw the 17-year-old during a stopover with a tour group at the Cataby roadhouse on August 2, 1999.

Mr Troy said he saw a female in a phone box next to the one being used by his nephew during a rest stop at the Wheatbelt roadhouse about 10.20am.

He described her as having black or dark brown hair, 150cm-160cm tall with a “slight build”. At her feet was a bag with the word Equip on it, he said. The court has been told Hayley was carrying a backpack with the word Equip on the flap the morning she disappeared.

Mr Troy said after he saw a picture of the missing girl , he “started thinking where I had seen her”.

“I think that the girl in the phone box is the same girl as the picture,” he said. His nephew Jason Rogers, 38, testified he also saw a female with an Equip bag in the phone box but under cross-examination could not say how old she was.

Hungry Jacks worker is 100 % certain he saw Hayley 5 days after she went missing!!

A former Hungry Jack’s employee says he is “100 per cent sure” Hayley Dodd visited the store in Armadale five days after prosecutors say she was abducted and murdered.

He said that after comparing the girl with the picture he concluded it was “the exact person”.

“I’m 100 per cent sure it was her,” he said.

Mr Catanheira said he called police who came to the store, which he said did not have CCTV cameras.

Under cross-examination, Mr Catanheira said he did not ask for the girl’s name.

He agreed teenage girls with white skin and dark hair would frequent Hungry Jack’s but insisted there was a “strong resemblance” and disagreed with a suggestion he was mistaken.

Larry Puls testified he saw a teenage girl hitchhiking in Mundaring the day Hayley went missing.

He called police after seeing Hayley’s picture in the newspaper.

“I believe I saw that young girl hitchhiking on the side of the road,” he said.Asked by prosecutor Brett Tooker if the picture may have influenced what he told police he saw, Mr Puls said: “It’s possible”.

A tour bus driver told police in 1999 he saw Hayley in a phone box at the Cataby roadhouse four days after prosecutors say she was murdered.

https://thewest.com.au/news/wa/hjs-worker-100-per-cent-sure-about-dodd-sighting-ng-b88663068z

Two from the Hungry Jacks store, Larry Puls in Mundaring and the tour bus driver all saying they reported seeing Hayley at the time to police after she was supposed abducted and murdered by Wark.

What is going on here?

Could Wark be innocent and staged his motorbike crash as he knew who abducted Hayley and that he likely to be blamed if he didn't have a solid alibi?

I am told Francis John Wark grew up in Mosman Park. Was he a gardener at Iona? I remember media saying the Iona gardener was questioned.

A forensic policeman who collected a seat cover from the car of Hayley Dodd’s accused murderer says he didn’t see an earring that was later found lodged in the fabric.

In court, WA prosecutors have argued the earring found in convicted rapist Francis John Wark’s car likely belonged to the teenager.

The 61-year-old has denied killing the petite teen, who was last seen walking along a road near Badgingarra, where he lived, on July 29, 1999.

An old ute Wark drove that day, borrowed from his boarder John McConnell, was seized by police one week after Hayley went missing, and the bench seat cover was packaged and sent to the state forensic laboratory.

But it remained there unexamined until September 2013 when an earring matching a description of the style the 17-year-old was wearing was found caught up in the fabric.

The earring, depicting an ancient Egyptian symbol representing life, is one of two key pieces of physical evidence against Wark in a case that has been described as entirely circumstantial.

Sgt Davison said his focus was to carefully remove the car seat cover so trace evidence such as hairs and fibres were not dislodged, and send it to the state pathology service where it could be examined in a sterile and well-lit environment.

Four years ago, Pathwest scientist Tracy Horner was examining an item connected to the cold case disappearance of teenager Hayley Dodd — a seat cover from a ute — when her eye caught sight of a small piece of metal.

It turned out to be an earring, which forms a crucial piece of evidence in the trial against Francis John Wark, accused of murdering Ms Dodd 14 years ago.

https://www.perthnow.com.au/news/wa...r-says-earring-could-be-planted-ng-b88670481z

THE lawyer defending a convicted rapist accused of murdering WA teenager Hayley Dodd in 1999 says a key piece of physical evidence against his client could have been planted.

The judge-alone Supreme Court of WA trial of Francis John Wark is wrapping up, with defence counsel Darryl Ryan targeting an ankh-shaped earring matching a description of the style the 17-year-old was wearing when she went missing in his closing submissions on Friday.

The earring was only found in September 2013, when a car bench seat cover that police seized one week after Hayley vanished was finally examined at the state forensic laboratory.

The trial heard the evidence bag was open because the adhesive had de-laminated.

"The possibility that the earring was planted is open and it cannot be excluded," Mr Ryan said.

Verdict expected around January. How about all the sightings of Hayley after she disappeared?
