He may have sought Leave to Appeal but there are very strict conditions in which this will be allowed. Whether the leave is granted and an appeal allowed will be something we'll have to wait & see. Quite a few of the judges decisions in the trial seemed off to me. The point of appeal & what they will try to pick apart is the question. It could go either way.

Kirby wrote an interesting piece regarding Mallard as he was the only judge that sat on both of his appeals, unsuccessful and successful. He explained that if Mallards lawyers had argued a different point of appeal in the first attempt, it would have been allowed. Instead they choose the wrong thing to appeal against which meant that although the conviction was unsound, the decision to not allow his first appeal was correct. He also said the decision to overturn his conviction was correct.

I seriously don't know how Mallard sat in a prison for so long. McGinty said he was no angel, and I'm sure he was not allowed to say anymore.

The minute evidence (lost in the property room) had not been presented by the prosecution, there should have been a turn over.

Mallard wrongful conviction, then the next accused commits suicide with a knife in prison. Nice security. Its bad really when its the same case. Dead people don't talk I guess.

Not implying, Im asking. Did Rochford ever use drugs? He looked rough at times.

I thought that straight away. Wark may have sought it, but will appeal be granted? The Queensland cops are ready to jump. If he appeals, he may end up back in Queensland which he wont like.

With what appears a complete audit of property, 2018 is a different era.

A weapon was never found in the investigation into the death of Ms Lawrence in Mosman Park, a murder which led to the wrongful conviction of Andrew Mallard.

You would think that it much harder to be granted an appeal today based on evidence.

Wark’s lawyer Darryl Ryan said it would be argued the guilty verdict was “unsafe and unsatisfactory”. [This was a judge only trial]

Why would an officer shut down the search for a murderer when a suspect was there?

Did Wark get right of appeal?

Heartbreak in futile psychic search for murdered teen Hayley Dodd.

THE mother of murdered teen Hayley Dodd has vowed to rethink future searches for her daughter's remains after a site identified by a psychic failed to deliver clues to her final resting place.

The psychic believed 17-year-old Hayley's body was buried five kilometres away from her killer's home, off a quiet stretch of road in Badgingarra.

Margaret Dodd says specially-trained dogs had also picked up a scent in the area.

"This spot has come up time and time again basically because this woman truly believes Hayley is there," Mrs Dodd said.

"What choice do we have, we started digging."

The latest search drew a blank and Mrs Dodd has vowed not to undertake another because of the heartbreak it had caused her family.

The only exception would be if Hayley's killer reveals where she is buried.

"It put me really really down, it's messed around with my daughter's head."

His lawyer, Sam Vandongen, today argued there were "anomalies" in the collection and storage of an earring found embedded in Wark's car seat 14 years after the disappearance.

The jewellery, worn by Hayley on the day she vanished, was missed in the original police search.

The appeal also claimed there was no clear reason for why Wark's alibi, that he was shopping 50 kilometres away, was rejected.

Interesting. The Dodd family are from Pinjarra.

Pinjarra’s Ray and Margaret Dodd are among those still waiting for closure, almost 20 years to the day since their 17-year-old daughter Hayley went missing from the Wheatbelt town of Badgingarra in July 1999.

Sharon Mason was killed in 1983.

63 years of age. Moved there in 1984.

Did he like Dave Warner concerts?

Kerryn Tate would be 59-60years of age now.(Missing in 1979)
