I need a few more minutes to take it all in, looks like most grounds 1,2,4 on were dismissed. I'm curious if the hair they found in Wark's truck had DNA on it?

The tiny hair DNA found in the car was DNA'd & linked to likely having been related to Hayley's mother - the car Wark had access to that very day.
Hayley had been in Warks car that fateful day.
The car Wark borrowed from his Lodger and, the column stick was damaged, car parked awkward position (no doubt in the struggle when she also lost her earring)
Poor Hayley - her poor mother and family

Judge spent over 6hrs one day in the Supreme Court analysing the butchers evidence - and the receipt that Wark had been to the butchers (therefore could not have killed Hayley) ...... receipt did NOT have the correct date-time. It was so laborious to listen to

Oh Wark is guilty (I believe)

Wark had time that day - it was his MO - he took off lying to all and sundry that he had cancer - left 4mths later on the back of a motorbike with his dog.

Hayley's earring was cocooned in the folded dirty car seat and WAPOL left it for a decade without looking at it , the exact earring that her friend had seen Hayley purchase - the exact same! FFS

Appeal should never have been granted.

My siblings went to school with Hayley. So terribly sad. My heart breaks for the family.

This is such a terrible situation for her family.

I remember when I first read about the earring, which should have been found years prior. I just kept thinking what a shocking utensil up it was on WAPOL’s part. It created so many uncertainties as to how it got there. Whether or not these prove to be significant, it creates an added layer of uncertainty for the family.

Such a delay also increases the likelihood of an unsafe conviction, which we are now seeing with it being sent back for a retrial. The family have to go through the stress all over again.

It seems to me that the delay in having any idea what happened to Hayley, let alone the delay for any justice, was completely unnecessary.

I have no idea, when the defendant hasn't made any admissions and maintains complete innocence that a jury can find not guilty on murder but guilty on manslaughter.

Agree, the manslaughter conviction seems weird. Maybe the cops are worried he will appeal again so they're going all out to find her on the property he was living on, I'm told they've ripped the house apart and then switched focus to a water tank.

That’s my guess, desperate to find something. They tore the house back to not much more than the studs and foundations the first time. The bloke who owned it at the time lodged a complaint against WAPOL for the damage done. Was uninhabitable after they finished with it. The earring evidence is so dodgy, especially after it only came to light after he was found to have kept an earring from another victim.

WA Police Commissioner Chris Dawson was on the radio on several stations this morning and said the search was triggered by something Wark said during his trial. I hope for the family's sake that Hayley is found and laid to rest properly.

Hes now had 2nd trial early 2021 - Jury and found guilty of manslaughter
He'll never get out of jail

Killer and rapist Francis John Wark described as an ‘evil man’
Chris Dawson (Police Commissioner) said Wark had received the sentence he deserved – a record 18 years in prison for manslaughter – after being found guilty for a second time of killing the 17-year-old girl in rural Badgingarra in July 1999.

Justice Hall said he was satisfied beyond reasonable doubt that hair and an ankh earring found in Wark’s vehicle belonged to Hayley.

Wark was already serving a prison sentence in Queensland for repeatedly raping a woman he gave a lift to in June 2007 when West Australian police charged him in 2015 with murdering Hayley.

If Wark serves his entire prison sentence, he will be aged 81 when he is released.

Why not? If it was planted by police it likely didn’t belong to Hayley as she has never been found. I have no doubt Wark is a piece of s**t but I’m also not 100% convinced he killed Hayley.
