Dustin Martin’s father Shane Martin has been denied entry to Australia despite claiming he has Aboriginal heritage.
Australian Border Force officials stopped Martin from entering the country when he flew into Sydney Airport on Sunday night. He was ordered to fly back to New Zealand Monday morning.
Border Force said the removal of "non-citizen Martin from Australia “was conducted lawfully”.
"The removal followed a decision by the Federal Circuit Court to dismiss Mr Martin’s application for an injunction seeking to prevent his removal from Australia," it said.
"Mr Martin’s claims of indigeneity will be considered along with any evidence in support of these claims while he is offshore."

Its amazing that this ruling effectively means a mass murderer could avoid deportation by having an aboriginal relative from the 18th century (which govt has to disprove not the claimant) suddenly decide they are aboriginal when faced with deportation and having their lawyer find an elder to "recognise" them.
Aboriginality is now effectively a meaningless commodity (unlikely to be treated as such by real aborigines but certainly will be by whites who are 1% aboriginal and out for a quick buck selling recognition or the other benefits like affirmative action jobs ).
The law must have a clear cut minimum genetic % (like 25 or 50%) where benefits are attached.
Of course if they moved overseas before 67, they should be allowed back as they were unfairly denied citizenship back then.
I wonder what the greens would say if a white person convicted of domestic violence was saved from deportation on a technicality but I guess aboriginal rights are more.important to them than the safety of women and children.

Maybe that is the solution, just have some elder declare us all aboriginal, the distractions will be gone and we can get on with dealing with the real problems and help aborigines in need not just the latest fad outrage on twitter.Everyone and anyone is aboriginal based on the current criteria

There is a good reason why contempt of court is no longer the name of a criminal charge but is the normal thought of Australians.What a loophole for criminals! I see today that Dustin Martin's old man arrived in Australia six days after this ruling claiming he has indigenous blood and demanding to stay. Well done high court!
So the high court of Australia is saying that the modern Australian state cannot kick people with Indigenous Australian Heritage out of Australia on the basis of them being alien.
WHat is the problem with this exactly?
Because its based on race, when that should not be a factor when dealing with questions of immigration and citizenship.
Its a regressive and potentially dangerous ruling for what is meant to be a modern secular multicultural society.

This is what most people don't understand Australian Federal Constitutional powers in regards to indigenous Australian allows it to make laws specifically for the benefit for them only. For instance Abstudy, Aboriginal Health services etc could be challenged without these specific powers. So now the high court has differentiated Australians according to race and we have non-govt organisations determining who is what. We no longer have govt control of borders. The concept of Aboriginality is becoming a divisive and financially lucrative field.
