So why would an insurer push to have an almost un-winnable appeal put through - unless they wanted absolute finality of the outcome, to reduce some payout risks (players) and remove others (court costs coverage?

Likely scenario. At the end of the day, if the rise in membership can be sustained, then we will be fine.
