That's my point exactly. Hird must have been more than a bit concerned that a SCN was coming his way. Because the ONLY part of his action in the Federal Court which was not fully covered by the concurrent Club action in the same court is 2. restrain the respondent (asada) from issuing a SCN to the applicant (Hird).

Everything else in his application to the court is covered by the Club.

So why was he moved to spend 7 figures on stopping a SCN that hasn't come? Guilty conscience?

A significant barrier to that would be a non-decision for the players. Once they're found guilty, it's going to be a lot easier for them to nail Hird with a SCN. After all, if CAS finds the players not guilty, they can't really nail Hird for anything now can they?

I would say its more likely that the players showing higher levels of Tb4 were actually injured at the time of testing. We had alot of injuries throughout 2012 & 2013.

But thats my take on it. it will be intresting what CAS make of it.

Maybe only 2 were urine tested at that time, maybe the players were injected at different times. Plenty of reasons why this could have happened to 2 players, doesn't get 32 Essendon players off the hook IMO...
