So if she didn’t post the picture then really all that’s left is that he did it himself by mistake which remains as hilarious as it was at the very start of this
She was on the other side of Italy from where he was, so I think her alibi is fine. My guess is that Sayers is old school and not too great on simple tech tools.

I have said to many a friend that the phone manufacturers (Android and iPhone) they need to have an AI filter detection function anytime a Dick Pic selfie is taken and they access the “Send” function with a pop up.

“You really want to send this and risk your career and reputation?” Warning 1

“Hey numb nuts. This is your last chance for me to beat some common sense into you” Warning 2 and finally

“You call that a penis. I thought it was thumb that had seen better days. Go pleasure yourself and switch off the phone” Final warning

So Luke’s response to the investigation was to sign a statutory declaration to the effect:

- My wife did it

- She suffers from significant mental disorders and often refuses to take prescribed medication

- You can’t interview her to get her response to this because she’s unstable and can’t be trusted

The AFL and Carlton took this on face value.

They've ****ed this up. If you're going to appoint yourself as an investigator then you have to do a proper job. You can't take a statement that says "She did it all, you can't ask her, she'll just lie" and that's it.

You have to make a reasonable effort to gather all the facts and that includes giving the accused a chance to give their side of things. Of course it's sensitive if there's mental health issues - so you make sure she's interviewed in an appropriate way with her own legal and personal support people present.

I’m doubt it could be brought up as a criminal charge of perjury against the CFC or AFL, but if Cate wins (and I’m betting she will - there’ll be no out of court settlement in this one) - the Media will have a field day and heads will roll, most likely Dillon’s, Gleeson’s and the Chief Investigator.

This kind of corruption, where the AFL is seen to have a hand in facilitating a perjury should be a warning shot to the new Chief Commissioner of the AFL - you are not above the law.

I'd love that, but doubt the many in the media will go for them.
 
This should never have made it to court and is waste of resources. Surely two grown adults can sort this out in private.
 
Old mate would have to get the 10 Sunscore points and the 3 votes for being the most tish bloke in the game. Clearly thinks with the little head too often as it appears he has never heard that saying about a woman scorned.

The obvious next question for Sayers would be "Riiiiiiiight... now can you tell me a bit more about this woman who was tagged in the photo?"

Is she going to appear? Because I'd say there's at least a decent chance that she wants to bury him too.
 
Luke Sayers' position is essentially that (a) his bipolar, split personality wife (he managed to stay married to for 30 odd years), (b) who gave him an STD (c) due to her "sexual history" (read **** shaming), (d) caused him to take a photo of himself to document a medical issue (but he didn't crop himself out, or delete the photo after). (e) She then somehow "hacked" into his phone while he was 350km away skiing and (f) posted said picture (g) while refusing to take her pills (h) which she had a tendency to do. (i) All of this caused him to defend himself to the AFL in its official investigation. (j) Then, she "hacked" into his phone because she knew his passcode and (k) illegally obtained a draft statutory declaration he and his lawyers were making up, and so in the course of defending himself, (l) he is entitled to a special legal defence to defamation that he was merely defending himself in an "official AFL investigation" and only wrote what was strictly necessary for his own defence, and there was no predominant purpose of malice to his wife at all but that (m) the AFL shouldn't interview her because she's too unstable and untrustworthy. Then, he enlisted (n) two of his adult children to publicly support him.
 
All in all, on reading the legal basis for his defence, the onus will be on Cate and her legal team to prove that a predominant purpose of his defamatory remarks was not malice. It will turn on how Luke is cross examined and whether he is determined to be trustworthy that malice (towards Cate) was not a predominant purpose.
