An ex gratia payment might save a lot of money, if Austic decides to sue, he could get millions.

Scott Austic's lawyers have made a formal request to the WA State Government for a record amount of compensation.

She should have got more than 3 years in jail for destroying his life imo.

I watched this show which was on ch9 recently - a case in Scotland - seems to be enough doubt for authorities to take further action, but seems nothing being done.

BFew He goes off because he worked on a farm that had been known to not have any phone service. The first 20 interactions from supposedly him to the cop (pretending to be a child) was from his IPad that had been stolen and it was known the accused had no reception in this time.

Just read this article, and am concerned as to why there is nothing in the media about why the critical alibi evidence omission occurred in this circumstantial evidence only case involving an undercover cop as the only? witness.


In a published Supreme Court of Queensland ruling, Justice David Boddice found there had been a miscarriage of justice and Mr Leafe had been denied “a fair chance of acquittal”.

1. Leave to adduce further evidence be granted.
2. The appeal be allowed.
3. The conviction set aside.
4. There be a new trial.'
 
Just read this article, and am concerned as to why there is nothing in the media about why the critical alibi evidence omission occurred in this circumstantial evidence only case involving an undercover cop as the only? witness.
Having just read the reasons why in the March 2022 Court of Appeal document, I guess that trying to sum up the reasons why was put in the too hard basket.

The train finally arrived today in the Scott Austic case.
But looks like it didn't stop at the framing Station.
Next stop ex-gratia.

As CLEAR as mud.
Not the required level of evidence to prove or support a charge of corrupt framing of a suspect.
There rarely is without a damning recording or video to prove it. Or multiple independent witnesses that directly saw something occur that shouldn't have.

Different levels of proof required for the framing, and reasonable doubt of the evidence.

Not to forget for those new to this case/thread that
'In May 2020 that court ruled there was “compelling, cogent and plausible evidence” that items had been planted and ordered a retrial, at which Mr Austic was found not guilty.
He walked out of jail in November 2020.'

I hope he sues and gets a very large payout. Even without the 'alibi' I'm surprised that some form of geolocation could/was not done on his 'alleged' messaging to show that it was sent from 'elsewhere', not where he was. It should never have gone to court.

A West Australian man who spent more than a decade in prison before being acquitted of murdering his pregnant lover has been awarded $1.6 million in compensation by the state government.

Announcing the ex-gratia payment in parliament, Attorney-General John Quigley said Mr Austic had initially asked for $8.5 million in compensation.

But he said the state government had decided to give $1.6 million to Mr Austic in recognition of the four-and-a-half years between his petition to Mr Porter and his ultimate release.

"This payment has been made following comprehensive legal advice analysing the circumstances of the matter obtained from the highest levels within the State Solicitor's Office," Mr Quigley said.

"That legal advice ran to 37 pages analysing and advising on all of the circumstances of the matter from the first prosecution right through to the latest CCC report."

That report considered whether there was any evidence of wrongdoing by the police or prosecutors, with Mr Quigley telling parliament none was found.

"I wish to extend my sincerest condolences to Mrs Thorne's family, who have been living with the heartbreak and the lack of closure about the circumstances surrounding her death for many years," he said

Ms Thorne's murder remains unsolved and is one of 64 cases to attract an increased $1 million reward for information under changes announced by the state government today.'
 
There is a lot of vomit in that release

They only acknowledge time spent once he petitioned

It was only legal advice not acknowledging the damage

Mr Quigley should say OUTSIDE of Parliament that no evidence of wrongdoing by police

And while an apology was made Miss Thornes family none was made to Austic
