Defamation law is pretty tricky and I'm sure others here know far more about it than me, but pretty sure Milligan and the ABC have a strong claim that the article was in the public interest as well as maybe that the content was true insofar as they were reporting an allegation, not that Porter definitively r*ped the woman. The ABC/Milligan don't have to prove that he did it in any standard of proof -- the case is about the content of the media piece, not about Porter's innocence or guilt.

In any case, this won't even get to court and is simply a stunt to give LNP MPs an out for whenever they're asked about it from now on, especially after the demonstration today. "It's now in front of the courts so it would be inappropriate to comment on it at this time." or something like that.

Can't see how they can prove this given there are no sworn testaments, if the media reporting is correct. Have a feeling this won't make court. Agree high risk for Porter as the last thing he wants is evidence sworn in court. Can't see how he can win - might just be a tactic to try and quash media discussion, especially from ABC.

My comment was in relation to 'being bullied'.

She was subject to bullying by this federal government last year. In an act of political interference they attempt to bury the 4 Corners report on what was happening behind the scenes.

As for the defamation I have no opinion on it. An allegation was made by the now deceased woman, no names were mentioned at the time. He outed himself before his name was ever reported by a news organisation. Although I must say, if Twitter was an example, social media were happy to name 'The Luggage Porter' amongst other names as to who it was.

Is this a way for Porter to take the front foot in any inquiry?

Surely part of the court case would be to establish if the allegations are true or not? Except in this situation, Porter has made himself the claimant.
