Surely part of the court case would be to establish if the allegations are true or not? Except in this situation, Porter has made himself the claimant.

Not at all, the chair of the quarantine inquiry made it clear that there was no reason public discussion could not continue over the matters before her; it was Andrew’s who said he had no comment to make while the inquiry was underway and he reserved his comments for his evidence, which resulted in one of his ministers having to resign. Defamation law is pretty tricky and I'm sure others here know far more about it than me, but pretty sure Milligan and the ABC have a strong claim that the article was in the public interest as well as maybe that the content was true insofar as they were reporting an allegation, not that Porter definitively r*ped the woman. The ABC/Milligan don't have to prove that he did it in any standard of proof -- the case is about the content of the media piece, not about Porter's innocence or guilt.

Her work will have been legalled to hell. As you say, there's a very substantial public interest element, although that acts more as reducing the aggravation than "getting them off".

It is entirely possible, and would be my prediction her, that Porter gets a nominal win but only after his entire reputation (what remains of it) is dragged through the mud but the judge also makes the finding that the ABC was entitled to publish much of what it did in the public interest.

In any case, this won't even get to court and is simply a stunt to give LNP MPs an out for whenever they're asked about it from now on, especially after the demonstration today. "It's now in front of the courts so it would be inappropriate to comment on it at this time." or something like that.

I don't think he can walk away from it now, but yes, it does serve that tactical purpose you describe.

No idea of the relevant populations, but if Stirling goes, it can be absorbed by four other electorates rather than two.
