If Sourasis has half a brain he will have no assets in his name. If he has pinched money, he needs to go to jail.
Would Pendles lawyers have an idea what's in his name?
If so, isn't court a waste of time?
It will cost Pendles even more.
Asking as you have experience in law.

Yes, deserves jail and his license as an agent stripped.

Hopefully Sourasis owns a home. Pendles may get a little back. It seems the agent owes money everywhere.
lending money out almost always ends badly.
My father wouldn't lend money to anyone, he said he'd rather give the money to them, as lending money is the fastest way to lose a friend.

I have zero experience in litigation. But there might be value in the management business which would also be a party to the action. Guessing their insurer would refuse cover, maybe there are other assets around, etc. There is talk of a big property deal out west- guessing the hope that that would come off is what kept the balls in the air.

The whole thing seems remarkable - and sad. If Sourasis was at the point at the start of the year of borrowing a relatively small sum of $300k and agreeing to pay $450k back in 12 months, he was clearly impecunious then. Pendles should have called in his lawyers immediately. People often won't believe the worst - and hindsight is 20/20.

Agree, thought the same thing, reminds me of the saying that: if the deal seems too good to be true, then it probably isn't.
I think you can read into it that these were two blokes with a very longstanding business relationship - one which has presumably involved heaps of "deals" - like the wine ones, etc.

Manager is in strife and asks for some financial accommodation along the lines of "I just need some dough until the land deal gets done. That's when I'll be able to pay you back X".

In hindsight and isolation, it looks crazy - but guessing Pendles wanted to believe what he wanted to believe.

Agreed. Being able to isolate discreet deals within an existing relationship very tricky. There may have been an element of not wanting to believe that things were dire.

It happened to the famous baseballer Shohei Ohtani last year. He let his translator manage his finances, who ended up siphoning funds from Ohtani's account to place sports bets, and pay back many of his gambling debts .

He ended up stealing close to $17 million .

Crazy how many unscrupulous scumbags there are in the world, just waiting for a chance to rip people off.

Lucky Shohei has that $700m contract to fall back on I guess.

Speaking of the great man, that game he played the other night is the stuff of legend. Bradmanesque levels above, if the Don also had the ability to bowl at 100mph and make batters look like fools. And quietly fill up his team mates' cups for them between innings.

If anyone is unfamiliar with Shohei Ohtani, check out the highlights of his game 4 against the Brewers. Just incredible.

Not to mention the squillions he would be earning on endorsements in Japan. BTW satty Ohtani didn't let his interpreter manage his dollars, the interpreter just straight out stole from him.

I do but not this type.

Having said that, the litigation doesn't cost much in the early days and I think is being used (quite rightly mind you) to squeeze Sourasis for what he can get whilst he's still solvent. Presumably there are assets or they wouldn't bother.

If Sourasis goes broke and then bankrupt from these other dealings, then Pendles will a long way back in the queue.

Go for it now I say and get what you can.

This guy was also involved in the Western United scam. interesting

Never trust a man with a mohawk and a disheveled beard.

That was a level above legendary. Was just in disbelief when I was watching it live.

It would be like Bradman hitting 250 in an odi during a chase of 265 , after taking 7 wickets whilst bowling between 155-160 Kmph .

Have to put him alongside MJ as one of the best athletes of all time.

Speaking of his contract, I have to say, maybe $700 million is far to less for what he has done for the dodgers and the league so far .

Apparently the Dodgers already turned a profit on the entire contract after a single year of increased total revenue.

From a business sense, his income is more than justified, for sure.

He won't want to be bankrupt. He will no longer be able to be an adviser/manager, will not be able to be a director of companies and will most likely be forced off boards etc. On top of that, Pendles will be entitled to a part of his future income from memory.

He will do everything possible to avoid bankruptcy.

Just to be clear, this POS was never a financial advisor.

The firm he founded and runs are financial planners, accountants, sports managers and he seems to also be running a managed investment scheme.
Once again HE isn’t an adviser. This is important as far as Pendles goes about seeking compensation.

And their website is a joke. Not once do they mention an AFSL. If ASIC was half competent they would be onto clown shows like these guys.

Pendles may have an inkling from past dealings as to what his assets are (if any); but he won’t be able to formally summon him for examination of his assets until he is successful in his court proceeding.

Though really, on a matter of principle, It is probably still worthwhile for Pendles to pursue this in the Courts. He could also apply for a warrant to be issued to the Sheriffs office to seize property to be sold at auction.

He may have a nice BMW and a few smart tvs which could cover something close to Pendles’ overall legal costs if it avoids going to trial.

My dad's business career is littered with stories of him trusting people with significant amounts of money and them not coming good. A handshake between mates was enough back then, baffling in hindsight.

Lawyers get involved at the very end. The relationship has broken down and the money owed won't be returned in full. Messy.

I mirror your views about Sourasis. The prick should be jailed.

I was once told by a very senior QC that his favourite word was principle. As soon as plaintiffs started using it, he knew things were going all the way - which meant full appearance fees
