why did he have to go to the Supreme Court to apply for bail? Why was he unable to attend his initial hearing?

cant cherry pick when it suits you

Russian man couldn’t attend hearing and denied bail.

And if you’re denied bail in the Magistrates court and apply for bail to be re-considered it has to go before a Judge in the Supreme Court.

Who is cherry picking? They should have had a bio secure room at Adelaide airport.....maybe just maybe if he had stayed where he said he was going to stay .......and not the Northbridge nightclub district on his way to get a Covid test at q-40 in the morning , we wouldn’t be where we are.

how is his problem with alchohol and authority the WA govts problem, when the magistrate asked if he understood what was being said why didn’t he say no your honour can I get a lawyer, and apply for bail, rather than. ‘Yep”

you are missing the point. It’s not about what happened before he got to WA. I’m making a specific point about him being remanded without an opportunity to present his case for bail in which case he eventually had to do through the Supreme Court because wasnt granted it by the magistrate.

he hasn’t had his day in court yet. You only have to look at the D’Ubois case - who is in a comparable situation to Stack to see the difference.

She camed in from Spain iirc - and the Russian also from overseas - fifo I think

Did he apply for bail? And when Sydney applied it was granted so i don’t see where you are going with this?

Stack was refused bail on December 19th.

He was unable to attend his hearing due to quarantine measures and Stacks lawyer wasn't even able to speak with Stack prior to the hearing on December 21 forcing the case to be ajourned to January 6th.

When Stack's case was heard on the 6th Bail was again refused. An application was then made to the Supreme Court yesterday who had the no bail order Overidden.

This whole article is making the point that Hakea prison is stopping men from exercising their legal rights and that women in the same situation do not face the same restrictions as men at the prison.

Totally bizarre that the WA government are allowing the pandemic to take away people's legal rights and due process. Stupid of them to take this sledgehammer approach but not put systems in place to support it.

The mask goes over the same anatomical features for both men and women on their face, not nether region.

He attended the second bail application that was denied.

All that was reported was stack said "yep" to the magistrate when asked if he understood why it was refused.

It would help us all if we actually knew what that reason was.

Must surely have some sort of privacy attached - a health consideration or suspected of one

outstanding question, absolutely outstanding.
I haven’t seen an actual charge outside of breaching quarantine, which I’m sure he’s now fulfilled.
This seems to be totally over the top unless there’s something else, but why would the charge be secret?

yep...if only Stacky went out for a facial and to get his nails done....
