Negotiation 102 - Ambit claims are absolutely pointless when you have bugger all bargaining power. Generally only people deluded by their own sense of arrogance would bother to give it a try.

I've been reminded of this statement recently:

"Dank’s lawyer, Greg Stanton, said if any charges were eventually laid, his client would challenge ASADA’s jurisdiction and the scientific basis for including peptides such as CJC1295, SARMS and Thymosin Beta-4 on a banned list"
So, if you find out that I injected the players with this shit, then I'll challenge the scientific basis of the charge because, you know, I'm Stephen ******* Dank and I know all.

Ha. What that says to me is that *Dank basically admits that he gave them banned substances but in his opinion it was ok because they should never have been banned in the first place. All that has to happen is for ASADA to prove what Dank already knows. The comment also says volumes about why * are in this mess and why it has played out the way it has, rather than playing out with any sense of rationality.

The only problem that "I'm Steven ******* Dank and you're not" misses is that even if he is shown to be correct, all you achieve is getting the substances off the banned list going forwards. But that doesn't change the fact that the substances were banned at that time and therefore could not be administered. Players still screwed.

This is really dumb. Dank should know that banned substances have no direct relationship with useful purpose. Look what the government bans/restricts:

Opiates - routinely used for medical purposes/in hospitals
Cocaine - routinely used for medical purposes
Ketamine - routinely used for medical purposes
THC/Cannabis - known and documented therapeutic benefits
Psilocybin (i.e., 'magic mushrooms') - clincially proven to assist terminally ill patients
MDMA (i.e., 'ecstasy') - clinically proven to assist with trauma patients suffering from PTSD and other ailments
LSD - proven to have reduced alcoholism for chronic alcoholics (and other benefits, same goes for other psychedelics)

The list goes on and on...

A list is a list. It's either on it, or it isn't on it. If he gave them substances on the list then the ASADA code has been breached. End of story. If he thinks he can win the argument in court then I'd like him to challenge the government's prohibition of acid.

Excellent point. This is just bravado by Dank and abject stupidity by his laywer to say it.

I have long suspected that Dank has ASADA over a barrel on AOD9604 on the basis of the compounding pharmacist / doctor's prescription exemption to legal use of non-approved substances otherwise banned under S.0 of the WADA code. He outsmarted the world on that one but got caught messing with substances that were specifically listed under S2. So now he is arguing that the compounding pharmacist has scientifically concocted a substance altogether dissimilar to CJC1295, SARMS and Thymosin Beta-4. Good luck with that one.
