Below is the latest from the age:- I personally enjoy the last sentence of the article, wasn't ol Jimmy boy sprouting that he couldn't wait to tell us all his side of the events?? Now he's saying they were forced to give evidence without confidentiality, maybe hindsight is a wonderful thing when you play out your side of a story via a 3rd party (slobbo) in the media.


A disappointed James Hird maintains that he and his players have been dealt an injustice, with the Essendon coach keeping his options open about a possible High Court Appeal.

Hird lost his Federal Court appeal on Friday, but continues to argue that the Australian Sports Anti-Doping Authority acted beyond its jurisdiction in conducting a joint investigation with the AFL into Essendon's sports supplements regime during the 2012 season.

Hird was overseas as Justice Susan Kenny handed down a judgment on Friday, but having returned to Melbourne he indicated the fight may not be over.

"We'll reserve our right as to whether we go to the High Court. I think we've got 21 days from Friday. We'll have a good sit down and think about it," Hird told Channel Seven on Monday.

Standing outside the Bombers' headquarter at Tullamarine, Hird expressed fears as to the implications of the decision. "We feel now that every Australian athlete or at least our 34 players and our support staff probably have less rights than the average Australian citizen."

Being granted leave to appeal to the High Court is not a formality. If Hird chooses to go down that path, he will need to convince several High Court judges that the four Federal Court judges who have assessed the case so far have erred, as well as why it is in the public interest for his case to be heard.

Hird, back coaching after a 12-month suspension, denied that he was trying to shirk the main game of whether or not the 34 current and former players charged with infraction notices had taken a banned substance.

"I've been roundly criticised for bringing this proceeding and then launching this appeal, but I feel very strongly about the fact that our players weren't given the right to go through a lawful investigation."

Except that *you weren't suing for damages, *you were suing to have evidence ruled inadmissible. What's that got to do with confidentiality?

Yes exactly right! But the reason for this is because you signed away your rights by wanting to play/work for the AFL and earn the big bucks! Who would have thought that they wanted to run a drug-free sport? ;)
