IMO there needs to be charges so some men get the message, a drunk girl is not an invitation to help yourself to rape with no consequence.

It probably wouldn't get to the stage of a charge if a drunk girl said 'yes' unless there was aggravating circumstances but in Higgins case, she claims she passed out and woke halfway through the rape, started crying and telling him to get off her. Given he is already guilty in the court of public opinion, raising a jury may be a tough ask.I don't envisage that Ms Higgins rapist would ever want to do anything other than exercise his right to remain silent.
