Why would they have encouraged MS Higgins to contact police over the incident, yet still have not terminated her alleged rapist's employment when they encouraged her to contact police over the incident?

Without knowing the details, does it come down to the beauracracy of sacking someone and having to tick all the boxes? The Government would play extra safe on these areas making sure all the documentation was in order before removing someone. Could explain the lag time.

Also doesn't really clarify whether the person was actually 'working' on-site or just technically on the books until that date.

'Man to face court for alleged historical sexual assault

A 26-year-old man has been summonsed to appear before the ACT Magistrates Court for an alleged sexual assault in 2019.
Police will allege the man had sexual intercourse with a woman without consent at Parliament House on Saturday, 23 March 2019.
Detectives from ACT Policing’s Criminal Investigations - Sexual Assault and Child Abuse Team, the specialist team dedicated to investigating sexual assaults in the ACT, first received a report in April 2019.
The investigation remained open and in February 2021 a formal complaint was made. Detectives have since spoken to a number of witnesses and collected evidence as part of the investigation.
Officers today (Friday, 6 August 2021) served the man’s legal representative with a summons to appear before the ACT Magistrates Court on 16 September 2021.
The man will face one charge of sexual intercourse without consent. The maximum penalty for this offence is 12 years imprisonment.

'“My client absolutely and unequivocally denies that any form of sexual activity took place whatsoever,” said barrister John Korn, of Sydney firm Ada Evans Chambers.
“He will defend the charge.
“The only thing that matters is what the charge alleges and he absolutely, unequivocally denies that any form of sexual activity took place at all."
Mr Korn added that his client was in a “very fragile state at the moment” and vehemently denied the claims against him.'


I very much doubt that we will ever get to hear anything more about what the accused is going to claim actually took place, other than assertions that there was no form of sexual activity involved.

If it ever gets to court trial, I envisage that the accused will be advised to maintain that line of defence, and imply that Ms Higgins was making s**t up, or just imagining things happened that never actually happened. Possibly questioning Ms Higgins state of mind, and trying to make the judge or jury feel sorry for the accused's current state of mind/health being a direct result of the accusations made by Ms Higgins that led to him being charged.

'Former Liberal staffer Bruce Lehrmann can be identified as the man who has received a summons to appear in an ACT Court on September 16 over allegations that he sexually assaulted Brittany Higgins at Parliament House.

Mr Lehrmann, who is said to be “distressed” and shocked by the single charge of sexual intercouse without consent has vehemently denied the allegations and vowed to clear his name.'

Doesn't the girl being heavily inebriated make the giving of consent impossible, and count against the accused?

is it known if he was equally inebriated?

He is saying there was no sex. He said she said thing. And yes witnesses said both were drunk. One security gaurd( female) said she was not distressed after he left. However the law is very sexist, the male is held accountable when drunk. Men have be done because she was drunk and consented. Even though he was drunk as well. Hence why he is denying sex.

Lehrman hasn't been convicted. Does this risk prejudicing the case?

It might actually. Let's see if his lawyers have anything to say about it.

I was thinking the same thing just now.

You'd think that Morrison would have received legal advice on the ramifications of what he planned to say today.

That him and his advisers knew exactly what they were doing.

Might they try and move the trial out of the ACT so that it can be a trial by Judge alone?
