Ombudsman basically told me to deal with foxtel and their internal ombudsman type area.

That seems awfully strange what the ombudsmen told you, weren't you paying them still? If so you should have had a good case to get it escalated and dealt with within 14 days iirc.

I took the issue of them refusing to do the install to the ombudsman, the payment thing is via Telstra which I am going to bring up once all this is finished.

You have to attempt resolution with the vendor first before going to the ombudsman. Usually the mention of the ombudsman is enough to sting them into action.
