Does anyone even know what the speed limit was there? He may not have been speeding at 120.

It says he was above the 120km speed limit, not driving at 120km/hr. That being said, I'm finding the insinuation a little bit gross without anything more explicit. Was he going at 125km/hr briefly to overtake a truck? Or was he speeding along at 150km/hr recklessly? Without more detail it's veering a touch into victim blaming pretty shortly after his death.

While speeding to overtake is (by definition) illegal, if it's only done briefly and done to ensure the safety of your car (if for instance you're overtaking a wide truck) and occupants, then it's the reasonable course of action. What would be far less safe would be sticking to the speed limit, overtaking someone who is doing slightly less than the speed limit, but then mis-judging and cutting in front of them too close and having them ram into the back of you as you're changing lanes.

It can make sense on a single carriageway, so you minimise the time you are exposed to oncoming traffic. But there's no safety reason to break the speed limit to overtake on a dual carriageway.

I've just described a perfectly legitimate reason.

If there are bulky trucks on a road it's also acceptable to accelerate past them rather than driving alongside/just behind them. It may not be by the letter of the law but I think you'd be very unlikely to be pinged for accelerating for less than a minute.

There's a very good reason.

Keep left unless overtaking. Or keep right in Europe.
 
That doesn't make sense. Suppose you're travelling at 120 on a dual carriageway. You don't have to floor it to quickly overtake and get back into the right lane.
Why not?
 
Just asked my former coach who is Superintendent at Vic police and is in charge of traffic and roadblock stops. No excuse is acceptable to exceed speed in Victoria.

He said the only reason given that's be accepted, albeit in rare occasions, is exceeding speed to get to a hospital in time to save a life.

Almost as if I said above that by the letter of the law you can't. You should ask him about jay walking too.

101 kmh in a 100 zone is also against the letter of the law.

However in practice this is never penalised with an offence.

I was going to say it was a bit rich for dwarves to hire themselves out and then complain about it but when you go to the article it is some disability group complaining and the dwarves themselves are defending their right to do it
