They're different, though. We can't claim we have been punished by not being allowed to trade a commodity we obtained illegally. Or, to be precise, retained the services of illegally. It's ridiculous to argue that we've been punished by losing the ability to trade something we shouldn't have had on our books in 2012 to begin with.

The counterargument to that is, well, we could have traded him three years ago, and yes, you're right. But we didn't. Instead, we signed an illegal deal. That's not an AFL punishment, that's us trying to maximise our return, illegally, and having it exposed. You don't get to count it as your punishment, any more than a thief gets to request his punishment be reduced by the amount he would have been able to sell his stolen products for.

Losing picks 20 and 54, on the other hand (you're right, it's not a trade of picks since we already had the others), is a punishment. Those picks had nothing to do with Tippett, they just happened to be our top two picks when the shit hit the fan.

Again I cant agree even though I understand where your coming from and I am also no legal expert. As I see it back in 2009 what we did was not illegal. We might have broken a rule because we didnt advise the AFL but Tippett was legally our property. Perhaps I splitting hairs between acting illegally and breaking a rule.

Tell me, what would happen if we decided to challenge the rule in a court. You can create all the rules that you want but it doesnt necessarily mean they are legal even if we have agreed to the rules. This is also why the AFL is concerned about getting into a situation where their rules are challenged by an individual under the "Restriction of Trade" process. Again perhaps I am splitting hairs but I can not agree that the lost of Tippett should not be considered by the AFL as part of our loss.
 
Geez you're optimistic WW...and I like the way you think, but I dont think we fessed up voluntarily; I think we were blackmailed into it by maybe Sydney.
The chain of events from then just gets shittier and you can suck up to the AFL handing in a couple of draft picks but you still cant polish a turd.
Judd and Adelaide appear to be different kettles of fish...yes they both stink, but they are different.

I thought I read/heard somewhere that Gold Coast had tipped off the AFL during trade week that something was up before we confessed? Seems so long ago now.:confused: :(

The problem with all this is ....if they belt us, it leaves Melbourne about to be sent to liquidation ...they can't survive

The Adelaide penalty will in many ways define Melbournes future

Can't tell me our issues are worse than Melbourne tanking

Interesting point that I did not put into my calculations. Just goes to show how much sh#t the AFL has put themselves in with the way they run their ship.

They have a contract for TV right for the next 4 years where they need to have 18 teams so have literally guaranteed survival for the Norths, Bulldogs and Demonds etc of the competition.

Melbourne are screwed in my opinion because their seems to be evidence of tanking (deliberately making on field decisions that affected a result that were discussed by the coaching staff prior to the ball being bounced etc) compared to "tanking" in a way that was within the rules i.e sending players in for surgery with a few round remaining etc (Collingwood, WC, Carlton were guilty of this to name a few).

Bottom line is sooner or later all of this will blow up in the AFL's face .... they have played favourites with some teams and run other teams over the coals, given soft draws, taken away revenue spinners from some clubs in favour of others etc etc etc etc .... in the end the piper will be paid and I am looking forward to it.

All I can really say is geez I have no clue what will happen but the AFL has painted itself into a corner and I am just glad that my team is not one of the teams that is in the middle of all of this.

Unfortunately the same cannot be said for the AFC but what I would like to see is if you guys get reamed the you go for the AFL's jugular in the courts ... again something that is unsavoury because I am sure the AFL has a long memory (I am sure some of Carlton's penalty was the AFL getting square with Elliot).

Its a bit of a damned if you do damned if you don't scenario.

Again I want to see it happen but would not want my team in the middle of it.

Like I have said repeatedly just one enormous cluster f@&k.

Yes, but if we had succeeded in trading him to Brisbane, it would simply have been "getting away with" trading in our illegally-obtained commodity. It wasn't our right to secure a trade for him because we obtained his services illegally to begin with.

Of course we lost that opportunity to trade for him, but it's not a punishment. It's simply a failure to obtain an unfair, illegal advantage.

What's the meaningful difference between consequence & punishment of our actions?

1. He goes to GC, we get compensation (min 1st rnd) and keep bock
2. We trade to brisbane for 12 + 23

The loss of these options is a consequence of our action and should be added to net loss

There were no options to lose him for nothing short of burying our heads in the sand. Regrettably the option we chose
 
I would love to believe the optimistic version but...while the media has been all over the place on this, they've been all over it in one direction, ie that we're going to cop a pasting. Every club 'source', every 'the AFL is of the opinion', every half-arsed commentator from SEN to the ABC thinks we've got something big coming. Even if it's just that the worst case scenario makes for a better story, you'd think that someone* would be mounting a case for 'minor indiscretions' if that's what they were.

I think I'm just trying to convince myself it's going to be terrible so that if it's slightly less than terrible it'll seem like some sort of victory.

That's why the club is briefing the media on the terrible things coming?

So our not quite as bad pineappling looks a victory for our robust defence & expensive legal team

We're being setup imo

I don't know, there seems to be a massive case of shadenfruede going on here. It seems a lot of people couldn't give a shit about what we've actually done, they just want to see us punished because it would be so much "cooler" than us just getting a slap on the wrist. Hell, look at the fuss that surrounded VB's and Danger's 3rd party deals, all that was happening was they were being investigated. They were ALWAYS going to be investigated, that's what happens when you invite the AFL to audit your books. It all turned out to be a big hulloo about nothing, but the media were trying to make it sound like we were serial offenders.

Personally I don't think the media have any f'ing idea whats going on, or what we've really been charged for and they're purely speculating for effect and not necessarily accuracy. I do hope the AFL realises that by preventing us from trading Kurt and our relinquishing our first 2 picks is already a considerable punishment.

Agree with this and posted the same yesterday. At no point in these proceedings have we leaked a word to the media. Suddenly the media has sources devulging information. Bit too convenient imo.

Scandal will sell more papers, so it's natural they'd report it as something huge, even if it turns out to be minor. Controversy creates cash as they say.

And then there are those who as you say, just want to see the Crows get hammered for no other reason than they think it'll be funny.

In my young married life I was in one of those pageants raising money for children with cerebral palsy. While the "winner" was the ditzy blonde bombshell (beautiful soul too, just not much between the ears), the winner to me was always the woman that took out the charity queen title. She raised a ridiculous amount of money on her own - more than any other contestant in the history of the pageant, and with the rest of our combined fund raising, they were able to build a respite home for the kids and their parents. I will always, always believe that - ms poppins or not. :p
