Transfers are effectively contracts between clubs and under FIFA rules, and probably the laws in the clubs respective countries (although I'm not 100% sure on that one), are legally binding. It would be a massive shitshow and almost certainly go to the CAS and possibly legal action if a club didn't abide by the terms of the agreement.

FIFA won't allow a club to have control over a player who isn't registered to them.

Buyback clauses are effectively gentleman's agreements and go against FIFA guidelines. They are only worth the paper they are written on if all 3 parties want the transfer to happen. Otherwise they mean jack shit and are unenforceable.

Everton about to sign Henry Onyekuru for £7m, this has come from no where but now appears all but official. Looked set to join West Ham yet we're about to sign him and loan him straight to Anderlecht for next season.

Turned 20 this month, is a Nigerian foward who had 22 goals and 9 assists from 38 appearances in the Belgium Pro League for KAS Eupen las season.

But that's not what it is at all. Seriously, what? In what way would a team have control over the player?

It works the same as a minimum fee release. It just means that the club has to accept a bid if it reaches a certain valuation. It doesn't mean that the player has to join. It's not an agreement that the player is a party to at all. If the club didn't accept it then it would definitely go to mediation, either at FIFA or CAS.

It isn't the same as a release clause because they usually result in a contract being ended if they are met.

FIFA wont get involved in buy back disputes. I can't think of an example where a club has tried to force a buyback option.

As stated before they are only useful if the player and selling club are happy to go along with it. We have a buyback agreement for Ibe - good luck trying to complain to FIFA if Bournemouth decided to sell him elsewhere for double the agreed buyback price when we want him. LFC cannot complain about a player who they do not own.

Fair to say West Ham fans on social media are absolutely ropeable about this.

Is Will Hughes full albino or does he just use a heavy bleach?

Been very good in this U21 semi though, looks a good signing for the Hornets.

What?

That is so wrong.

In that situation Bournemouth would be free to accept offers from other clubs above the buyback price, but they would also be obliged to accept Liverpool's offer if it met the previously agreed upon buy back terms. It would then be down to Ibe to discuss personal terms with the clubs who have had bids accepted, including Liverpool.

Transfers are legal agreements between clubs that are detailed, meticulous and involve ridiculous sums of money. A club can't just ignore the terms of that agreement just because they feel like it.

How can any club have right to complain about a player that they do not own? That is exercising control over a player that is not owned by the club. Club C cannot complain about a transfer between player A and club B. That's ridiculous, they don't own him.

Buyback agreements only work when all parties are in agreeance. It's as simple as that.

No better example of this than Alderwereld. Southampton had a 6.8 million pound buy out option which Atletico ignored because Spurs offered a bigger fee. They huffed and puffed about it but ultimately couldn't do shit about it.

He was as good as in an Arsenal jersey a month ago yet we'd had no contact. Henry has a very very good manager.

I shouldn't have laughed but some of the comments on Twitter were amazing.
Seems to be because he couldn't get a work permit, so that's why he has to be loaned back out, and we didn't want to do that.

And that Everton have signed what 5 players now and we only have the 1....

No. It's not exercising control over a player at all. This really isn't a hard concept to understand. I don't know how you're not getting it.

Yes they did, which Atleti were bound to accept. But TA wanted to join Spurs, which meant they accepted our offer. He still would have been free to join Soton under those circumstances, but he didn't want to, he wanted to agree personal terms with us. Atleti were still bound to accept the Soton offer.

Although, that example is a little flawed as there were disagreements over the amount of time that was involved and because it was an initial loan agreement with a fee attached that expired after 'X' amount of days. Even if there had have been no time discussion in the agreement between Atleti and Soton, TA still would have been free to reject the permanent terms offered by Soton, despite the fact that Atleti would have been obliged to accept the terms of the transfer.
