A buyback clause is usually a gentleman's agreement between the selling and buying club that says the original owner of the player (Chelsea in this case) have first go at buying the player if the selling club wants to sell.
Except when it's actually written into the contract.

Not sure where you've got the idea that a "buy back clause" is only ever a gentleman's agreement

it follows the same rules. it's just limited to one club.

It's a gentleman's agreement that needs all parties being ok with it. Chelsea couldnt force Ake to come back against his wishes by paying the fee. Bournemouth are not going to be forced into selling unless it suits them. Buyout clauses are rarely activated mid season, would be very surprising if it was in this case with Ake being a key player for them.

Interesting that you believe the future if a player is up to him and not the club that just invested 20m pounds buying him. Good luck trying to force that deal through with the FA.
 
Yeah, that's a buyout clause. Not a buyback clause. Bournemouth were wanting 60m plus for Ake in the summer window. If he had a buyout clause he would probably be gone by now.

When we sold him to Bournemouth we insert a price that only we could buy him back for if he wanted to come back. Its a buyback not a buyout as only we can get him at that figure, everyone else would need to pay Bournemouths asking price.

And you reckon they would have agree to let him go mid season? Can you name a single example of a buyback clause ever being activated mid season?

If you guys decided that you may need him at a stage like this you should have kept loaning him and subsiding his wages. That way you could recall him at the drop of a hat.
 
Haha im not sure what the confusion is, we put a buyback for a set fee in his contract when we sold him. Like Boga, Chalobah, Traore, T.Hazard ect we learnt from our mistake with Lukaku.

If Ake wants to leave its his call.

Some leagues like the French one dont allow it, its been widely reported we have a gentlemen's agreement with Lyon in reguards to Traores buyback and a set fee if we are ever interested.

Matic has effectively a 15m buyout clause right now. Not sure Mou would encounter too much resistance from Old Trafford right now if he activated it :) :) :)

and im sure psv would've liked more than 5 mil for angelino but that was his buy back clause.

if we wanted to we would've yes. but it was better for him to play out a season rather than sit on the bench

Really not relevant when it is quoting La Migs rules where buyouts are mandatory and enforced by the FA.

I'm willing to bet that Ake wont be your player at the stroke of midnight on Jan 1 for 40m.
 
If Ake has a buyback clause that Chelsea are willing to pay, and he wants to go he's gone. Don't get what's difficult to understand.

There are other clauses that give the selling club more of a say but a buyback is fairly straightforward.

Only thing I'd say is that if Ake does have a buyback it would be for a decent amount cause I don't think Bournemouth would have been knocking back £70m in the summer if Chelsea could just grab him for half that (and sell him on for a profit if they wanted).

Sit on the bench? You needed him in Jan, you had one fit LB at the time. You needed him more in Jan than the summer window window.

Its £40m. It does seem pretty straight foward if he wanted to leave.

Yeah definitely, if Bournemouths buyback terms were met he goes.

I find it unlikely they agree in his clause to leaving at the drop of a hat mid season. He leads their defence and is one of their best players. They need time to replace him.

Like you say them knocking back 70m plus indicates they believe he's going nowhere anytime soon.
