Its up to Messi to convince FIFA that he should be allowed to use an expired clause to end his contract. As things currently stand Messi is a Barca player until 2021 unless someone pays his buyout fee or pays a fee which Barca agree to in order to end his contract. The risk is with Messi, he could face a FIFA ban if he persists with trying to unilaterally break his contact.

He's done nothing that would warrant a ban, and will do nothing that would warrant a ban.
If he moves it will be because it has been sorted with FIFA, the Spanish courts or between Barca and Messi's new club.

Put simply, unless we have confirmation from FIFA or the courts, or we come to a deal with Barca we just won't sign Messi.
This idea that we'll sign him on a free and then get a three quarters of a billion knock on the door in a years time is just ridiculous.
FIFA wont allow the transfer anyway unless Barca agrees.
They could rule that the clause was still in effect when Messi exercised it. If that happened Barca doesn't have a say.

Like you have stated previously FIFA cant change contracts, I thought you were pretty clear on that. The free transfer clause has expired, they wont be approving a unilateral player transfer.
FIFA can't change contracts, its got to be something agreed between player and club.
Without knowing the exact wording of the clause it's impossible to tell if Messi has a case or not. Some talk that the clause had to be executed with 7 days after the end of the season. Others that there was a set date, but the extension of the season had an implied effect on other terms of the contract.
That's what FIFA and the lawyers will rule on if requested. You make it out as if it's black and white, right or wrong. Something like this is always going to be full of grey areas. Which is why I suspect all parties would prefer to make a deal.
I remember your responses to FIFA's suggestions of player contracts being extended automatically due to the longer season being pretty black or white. Theres no differemce here, Messi is trying to use the same argument with his expired get out clause. FIFA cant and wont help with that.

But player and club can, and unless you have some form of inside knowledge on Messi's contract and any amendments made to it I can't see how you could say with any confidence what the effect of those changes (if any) are. Or is this one of your "what I want to happen"legal opinions?
