No, the fax that Messi's agent supposedly sent says he wants a free transfer "in the spirit" of the deal.

The leaked fax says nothing about the "spirit of the deal".

This is what it reportedly says:

"By means of this letter, I, Lionel Andres Messi Cuccittini, with a white ID [blank], request that the employment benefit contract that I currently occupy in your distinguished club be terminated, based on clause number 24 that allows me to have this power. "

Also, pretty much every source is reporting that his contract has a yearly get out clause which requires him to notify Barca he wants to use it by the end of May and that it expired in June. FIFA are not going to intervene in that scenario and it would be inapproproate for them to do so.

I've seen numerous different interpretations of the clause, suspect most are guessing FWIW. FIFA won't intervene unless they are asked at which point they will make a ruling. They might rule for Messi, they might rule for Barca. Again, I suspect neither side wants to take that step and risk the ruling going against them. So a negotiated transfer is the most likely if he is to move at all.

Messi is under contract until 2021 and gling nowherre unless Barca agree to let him go.

FIFA ruling
Court ruling
Transfer between Barcelona and another club
Stay at Barca

Four paths this can head down.

FIFA wont approve a unilateral transfer. They are not a contract law dispute mediator - that would be civil court. The current contract until 2021 stands.

There's forner Barca board members reporting that they have seen the contract and that the get out clause has a set expiry. Dont see Messi or his representatives disputing that.

Surely only getting Koch or Luiz not both?

Yes I would imagine one or the other. Koch probably a certainty if Hay has run with it.

£13m would be a great deal for a guy that will be lining up for Germany against Spain and Switzerland in the next few days.

The Players’ Status Committee (PSC) and the Dispute Resolution Chamber (DRC) are FIFA’s decision-making bodies that deal with various contractual and regulatory disputes between member associations, clubs, officials, players, intermediaries and licensed match agents.

LOL. That's exactly what the FIFA Dispute Resolution Chamber is set up to do.

Think they’re going for both. Need the depth without Berardi and Benn Waite. Koch i read can also cover at DM.

Previously you argued that FIFA couldnt override contract law.

Now you argue they can. Which is it? The resolution chamber is generally used when parties are not honouring contracts btw.

Barca have done no such thing.

Its up to Messi to convince FIFA that he should be allowed to use an expired clause to end his contract. As things currently stand Messi is a Barca player until 2021 unless someone pays his buyout fee or pays a fee which Barca agree to in order to end his contract. The risk is with Messi, he could face a FIFA ban if he persists with trying to unilaterally break his contact.

There’s a lot of similarities between this and the Leeds/Redbull case. Can’t see them being split in their findings. If Messi is free to go, then surely Leeds can renege their deal for Augustin?

Wouldn't it be the other way around?

If Messi's clause is extended to match the extended season, then the compulsory buyout clause would be extended and Leeds would be obliged to buy Augustin.

As Moomba says I think you have that backwards.
