It really disgusted me that Channel 9 ran this as their main news story over the PM getting ready to say sorry or an update on the attempted assassination of Jose Ramos Horta.

Underbelly ban useless in file-sharing era
A BAN on the screening of controversial crime drama Underbelly in Victoria will almost certainly be undermined by illegal copies of the show being shared online.

A suppression order preventing the series from being screened in Victoria due to fears it could prejudice a murder trial was today issued by Supreme Court judge Justice Betty King.

But Victorians will almost certainly be able to see the show just hours after its broadcast in other states, thanks to the popularity of peer-to-peer file-sharing technologies such as BitTorrent and websites such as YouTube.

Several promotional clips for the series were still on YouTube today, despite their removal from the Nine Network's website in accordance with the court order.

"This is a great problem on the internet," said University of NSW Cyberspace Law and Policy Centre executive director David Vaile.

"Legal jurisdiction is typically limited by geography, and by its nature the internet doesn't place much regard to geography."

Mr Vaile believed Justice King may have taken into consideration the possibility that copies of the drama would appear on the internet, but that it would have limited impact on potential jurors.

"(She) may well have decided that something that is not the official publisher's website will not have the same sort of impact," he said.

However watching illegal versions of the underworld drama will not be without risk.

Mr Vaile said people caught uploading clips from Underbelly could face copyright and contempt of court charges.

"There is potential in some circumstances for that order to render people in contempt," Mr Vaile said.

He added that despite the belief that the internet provides anonymity, authorities would be able to track down any culprits.

"There is a false perception around that activity on the internet is anonymous or that's untraceable. Unfortunately, the opposite is the case," Mr Vaile said.

"The terms of service (on YouTube and Facebook) don't really offer any protection of privacy or anonymity."

Mr Vaile said website hosts such as YouTube and Facebook could also face charges regarding breach of copyright.

He added that once the clips were on the internet it would be impossible to remove them completely.

"Once it gets out onto the internet, subsequent copying is also a problem," Mr Vaile said.

"The further along it gets the harder it is to put back into the bag."


WTF does Facebook have to do with anything?
 
Just a heads up, no-one post a link to a torrent or to a site where you can see Underbelly. It could put BigFooty in a legal bind and we don't want that.

We don't mind people saying that a torrent is available on a certain site, but please do not put a direct link to the torrent. This has nothing to do with the legal case involving this show but with copyright infringement laws which torrents break.

I hate to say it but that doesn't surprise me.

The commercial free-to-air networks long ago abandoned any pretence of being genuine news services. They are all about stuff that appeals to simpletons (i.e. ratings!!!) and helps them cross promote themselves and their programming these days :(
 
Find someone with FTA satellite and watch it on west aussie WIN TV or Impargia.

Plenty of grey nomad parents with caravans would have one. But they can't watch it...that'd be illegal.

Can't believe the media hasn't bought that up, its pretty common equipment these days. No such thing as a single state broadcast anymore

ch10 and ch7 also ran it as the first story in Victoria,so you can't just blame ch9.

You make a great point.

Being on a jury for a underworld murder trial isn't on my top things to do list.

It always amazed me that when you saw neighbours or even a witness to one of these gangland killings interviewed on the news just how many gave their full name and identity.

PMing torrent links is fine. But you could say that is available on mininova and then people can go to that site and use its search function to find it. If they don't know how to find that site then they have this thing called google which is a big help. Why some people need to be spoon fed these things is beyond me.:rolleyes:

That's a bloody good point. What if a potential juror in this trial had read Big Shots or other material dealing with it all....


Nevertheless I am pumped for it.

Having watched it closely and read plenty about it since it all started im very interested to see how they portray characters, and if some of the murders themselves are shown as brutally as what ive read.... particularly the killing of Mark Mallia...

Did not realise that. I was watching the cricket so that went straight into 9 News at 6:00 and before the story ended I flicked over to 7 and they were just finishing a story on 'Sorry' and were moving onto Horta. I flicked back to 9 and they were still going on about Underbelly. 7 couldn't have spent too long on it for me to have completely missed it. I wasn't home in time for 10 News so missed that completely.

But that's typical of parents. They'll always defend their children no matter what. "He's a good kid/person" is something I always read when their son goes on a shooting spree or whatever.
 
It has been banned so 12 people in the whole of Victoria can't see it (or hear about it 2nd hand from their mates) not so the wider community of Victoria can't see it.

With that in mind I think it's stupid to ban it airing. The jurors have a lot of assumed responsibilities that the law doesn't enforce properly. For example they're not supposed to talk about the case outside the court but they all do. Any jurors in a high profile case that gets a lot of media coverage aren't supposed to be swayed by any biased media coverage (which there is plenty of in the newspaper who often get things wrong and assume things with little recompense) but they all are. The jurors should be expected to avoid this show just like they are expected not to be swayed by any over the top media coverage. I don't see any investigative stories on a current event that is subject to a court decision being banned. I don't see any newspapers being banned from covering a current event before the court. I don't see those books like someone said being banned.
 
Anyone knows if channel 9 managed to get an injection today on yesterday ruling.

They would have been mental not to try.

THE Nine Network has run out of time to have its banned gangland drama Underbelly screened in Victoria tonight after failing to lodge an appeal against its ban.

Nine said it planned to fight the ban imposed yesterday by Supreme Court judge Betty King who said the series could prejudice an upcoming murder trial.

But the Victorian Court of Appeals registry office said Nine had not lodged an appeal by 3.40pm (AEDT) today. As a result, there will be no court hearing today.

A replacement show, the movie The Shawshank Redemption, will be broadcast at 8.30pm (AEDT) tonight in Victoria instead of Underbelly.

Plans announced yesterday to screen an alternative program Underbelly: A Special Announcement have been scrapped.

The first episode of Underbelly will be screened in other states tonight.

Nine has 28 days to lodge an appeal from the time of the suppression order.

Justice King banned Underbelly until the completion of a Melbourne murder trial. The series was also banned from the internet.

Underbelly is based on a series of books written by journalists Andrew Rule and John Silvester on Melbourne's gangland war.
