Until a trial that is going to be completed later this year is finished, Underbelly is not aloud to screen in Victoria as the court believes it will influence the jury.

Can I just say again how ridiculously stupid it was of Nine to promote it so heavily when they fully knew something like this was going to happen.

No wonder they are the third network now.

Underbelly banned in Victoria

A Supreme Court judge has banned the Nine Network's Underbelly series in Victoria until after a murder trial over which she will preside.

Justice Betty King has today issued a suppression order until after the trial, details of which cannot be revealed also because of a court order.

The 13-part series depicting Melbourne's 10-year gangland war was scheduled to air nationally from tomorrow.

Justice King also ordered the removal of all excerpts from Underbelly from the internet.

"In my view, the criminal justice system is more important than your client's profit margin," she told Nine lawyer Brendan Murphy, SC, at the hearing.

"It's going to be in the lounge rooms of al potential jurors and once it is in there, you can't get it out," Justice King said.

"This is not the reporting of an event. This is television series made for entertainment."

Nine is considering an appeal, the network's lawyers said outside court.

Justice King yesterday gave defence lawyers and public prosecutors until Tuesday to view more than 10 hours of the Melbourne gangland drama to determine whether the series would affect the upcoming murder trial.

Nine handed over DVDs of the 13 episodes yesterday after being subpoenaed by the Office of Public Prosecutions last week, when doubts were raised over whether an accused Victorian gangland murderer, who cannot be named, would get a fair hearing.

Justice King, who also viewed the series yesterday, said the conversations in the drama would largely be "a figment of someone's imagination".

"It will be difficult for the viewing public to sift through what is factual material and what is fictional," she said.

"The series explains to a large degree why the person was murdered.

"That is really what is the subject for the trial."

Justice King said the series had an unfortunate aspect in that it tended to corroborate evidence associated with the trial.

She said she had a responsibility to weigh up the interests of the community and commercial interests of Nine.

"It's got to be a balance with the client's needs and the needs of the community," she said.

Under the order, all internet material related to the series is banned.

Justice King was particularly concerned about the characters and their relationships with each other as already displayed on the Nine website.

A Nine spokeswoman said the network was considering its options following the ruling.

"We are considering our options and, as always, will not be commenting on legal issues," she said.
 
Makes you wonder why they couldn't just get 12 out of the 1000 potential jurors who didn't watch Underbelly in the first place? It's not like all of Melbourne will watch the show, I mean c'mon, how many people in total watch any television event in Melbourne?

They could always watch it after they find out they're a juror. You know, skip to the relevant bits in the series, and sleep during the trial.
 
Same thing happened in NSW with Blue Murder.

Was always going to happen. Plenty of precedent.

Still, glad 9 are going ahead and showing it everywhere else. Really looking forward to it.
 
I would be thinking why would they even be showing this when there is still an police investigation going on with the gangland murders and the underworld.

Well as much as it pisses me off, the judge is making the correct decision here. ****in nine are so stupid. Well least we can laugh about it, there goes nine's one chance of getting back up the ratings in VIctoria
