yep - but any organisation, whatever their legal structure that is involved in trade and commerce is subject to the provisions of the Act, as matching state acts are written in accordance with the commonwealth act. Yes technically the act applies mainly to corporations as the commonwealth only has the power under Section 51 of the constitution for companies but there is matching legislation and national agreements which make it apply across the board.

Regarding 2.(iii), Gillon's comments here would seem to contradict that,

McLachlan said the historic deal delivered for clubs, players, supporters and the community.

He said the deal would provide financial security for clubs and players to "allow future growth and certainty".

Pretty dodgy that it's a private company(owned by no one knows), yet has a non profit tax exemption but makes huge profits - it's very clear that ALFred is all about the bucks and nothing but the bucks. You hit on governance 222, the AFL Commission & its executive run by McLachlan & the ever increasing number of side kicks. The Commission should be holding the executive responsible but I battle to remember any example of them doing so.
I regard the current Commission as believing it is above all & sundry (the fans & the clubs) & 'bunkers down' when questioned e.g Ms Hisgrove & Ms Ogg before her. Paid to keep her own counsel ?

I have underwhelmed by the AFL, both the Commission & the executive over the Adam Goodes booing fiasco, where Gil appeared to issue decrees the masses, sshhh it'll go away .... the still going Essendon saga that the AFL tried to sweep under the counter .... Melbourne & tanking .... the attempt to replace the Hawks in Tas with the Roos ... & on & on.

ALFred loves to manipulate outcomes - I'd really like to see him fall on his own sword(will never happen). Anyway, not much more that could be said about the ALF that hasn't already been said. But, I agree with your sentiments. The last 5 years in particular, imo, the AFL has lost the plot.

The AFL Comimission is a pretty good setup. Allows the clubs to pick the board without letting their own self-interest run the sport. Better than cricket and rugby union where the bloody state bodies pick the directors.
Everyone bitches about it, but I haven't seen a suggestion for an alternative that was not either demonstrably worse, or batshit crazy.
