Yes. His position as leader of the CFMEU gives him protection not afforded to normal people like you and I. And when someone attempts to prosecute him (or his organisation) for breaking said laws he uses his power/influence to threaten that person (like the we are seeing with McBurney).How the **** is this even close to being legal? Setka just needed to demand McBurney steps down on the basis of umpire performance across the competition this season.
